My son is in jail for the 4th time, this time drug possesion, I know he has mental problems, has been on medication but never diagnosed. If he request a mental evauluation, will this hurt his case? And does the state have to comply?

This us s great topic for your Son to discuss with his attorney. . If hr doesn't have one, you need to encourage and help him to get one. It is unlikely that a public defender will out to request a mental evaluation over pleading to a shorter jail time.
