my question is if biological parent are known drug users and repeat offenders in and out of jail do judges side with them or with fosterparents who have fallen in love with the baby that has been placed with biological siblings

Depends on the facts. You don't tell me enough here to really evaluate your particular situation. If you're a foster parent through CYFD, they can move to terminate parental rights and you can discuss with CYFD your options - adoption or foster parent or guardianship - then they can make recommendations to Judge. Biological Parents may be able to get some kind of supervised visitation. Judge's tend to give great weight to recommendations of CYFD.
