My wife and her ex husband are listed jointly on the first mortgage of his home that was awarded to him by the divorce decree which also states he is financially responcible while she is not. However he is now filing chapter 13 and is very in the rears on his payments which is affecting her credit rating. How can she get her name off the account short of refinance which the creditor requires?

Is she still legally liable for this account with the transfer listed in the decree?



Answer

She is still liable. The contract controls the liability and not the divorce decree. Sorry abut her situation, it is all too familiar.
