My daughter is the custodial parent of a 6 year old. Her ex-husband is in the 2nd phase (of 3) of visitation, which allows him to take the child for 8 hrs unsupervised. His oldest daughter recently got married and is having another ceremony in our state, where it is illegal for same-sex marriage to take place. My daughter is not comfortable with the 6 year old attending. Does she have any right to keep him from taking her?



Answer

It will be difficult to get in front of a judge quickly regarding this matter.

Generally, Dad can do whatever he wants while he has the child in his possession unless it is dangerous or harmful to the child

I don't know what judge you would see so it would be based on whether or not the judge finds a gay commitment ceremony harmful. There are no laws in Texas regarding this matter & no case law, that I'm aware of, that addresses this issue.
