If a person is going to trial for a crime they didn't commit and another person comes forward and confess what happens

Question

If a person is going to trial for a crime they didn't commit and another person comes forward and confess what happens

Answer

They still have a trial unless the prosecutor believes the person who comes forward and confesses. It takes more than just a confession, it takes confession along with some really good evidence to get the prosecutor to pursue the other person.

Answer

The prosecutor may prosecute the other person. If there is a trial it depends on who the jury believes . Of course two people could commit one crime and both of you could be prosecuted.
