I am looking to order a last will form online, as a temporary fix before leaving the country this weekend. I have an attorney working on an entire estate plan, but just wanted something for now. The download is titled "new-york-mutual-will-married-couple-with-adult-children". The form states, "This Will also allows the Testator/Testatrix to make specific gifts to others as well. This Will is suitable for estates worth less than $2,000,000". My question is, will the document still be legal if filled out properly, even though my estate is worth more than $2m ?



Answer

It appears this form does no estate tax planning, but might be acceptable as an interim, stop-gap solution. I do not know why the attorney cannot do a simple Will in the interim.
