Question

My daughter was convicted of a felony served her time & is out of prison. She has since gotten a charge of CDS with intent to disrtubute. She passed a lie detecter that the DA's said she had too Then she received a misdamener theft charge(Wal Mart) Can they give her an after former since it isn't a felony & not ebven of the same thing--meaning drugs?.

Answer

I am not sure that I understand the question. Felony after formers do not apply to misdemeanor cases. However, a misdemeanor Larceny of Merchandise from a Retailer can by enhanced to a felony by a previous LMFR conviction.
