My son has his dads lastname but his dad its not involved in his life, never comes to see him and no child support and he is soon moving to florida. No emotional connection just stranger and so it his fathers family, i was wondering if i could get full custody of him and change of lastname ?

You essentially have full custody of your son already, but just don't have a formal declaration. You do have the right to ask the court for a declaration that you have full custody, and your son's father can appear to fight it, but may not. You should visit Family Court.

You can file petitions in the family court for custody as well as for a name change. He will need to be served with both of these petitions. If you have him served in New York before he relocates that may make things easier for you.
