can a prosecutor tell a witness there is no DNA evidence when there really is and then dismiss the case citing lack of evidence even though there is also a confession? is this an ethics violation?



Answer

There is no ethics involved in the discussions between a prosecutor and a witness. And, the prosecutor has a boss who generally will be aware if a high level case is dismissed. If you have a complaint about a dismissed case, call the prosecutor to discuss. If you do not like the answer, call that prosecutor's supervisor.
