If i am convicted of a 2nd dui in Va within 3 years and am given the mandatory sentence, do i have to serve the 20 days from the conviction date concurrently, or can i serve them on weekends or under work release? I am a teacher and if i have to serve them concurrently from the .conviction date i would lose my job because i would not be out of jail in time for the semester.
Answer
Normally it would be up to the sentencing judge but you (or your lawyer) must
request it at the time of sentencing. (Also would need to clear it first with the prosecutor to ensure they have no objection.)
