If you cannot persuade your employer to stop withholding, or convince the owner of the judgment to tell your employer to stop withholding, the only solution I can think of is seeking relief from the court, by properly filing, serving, and noticing a written motion seeking an order from the court directing your employer to stop withholding, and to return to you any funds withheld after the seventh anniversary of the rendition of the judgment. The problem with this solution is that it is likely to induce the owner of the judgment to revive it, and it's a pain in the ass for experienced lawyers to take all the steps necessary to prepare, file, serve, and notice the motion, so you may encounter extreme difficulties trying to do that yourself. Therefore, if there's a modest amount of money involved, and you can pay it off in full within a reasonable time, either by permitting withholding after the seventh anniversary, or by additional payments over and above the amounts being withheld, I reccomend you pay off the judgment. Then if you need help from the court, you can seek it without fear that it will backfire.

You have problems. You can't just refuse to pay rent if the landlord refuses to make repairs. There is a process set out in the law that you must follow. Moreover, if you don't have a signed lease, the landlord can simply end your verbal lease at the end of the month with 10 days' notice. Never move in or give a landlord a deposit until you sign the lease (unless you want a verbal lease that can be cancelled on 10 days' notice).

As for your rent going towards a purchase, that is not the case unless you have a written agreement (lease-purchase, bond-for-deed, etc.). You can't agree to sell property verbally. It must be in writing.

You could try disputing with each of the credit bureaus, but chances are that they will not do anything. My advice would be to contact the Arizona Child Support Enforcement office in the county where your child is located and see if it can be determined as to why there are 2 separate reports. It may be as simple as having them correct this if one was reported erroneously. The problem I have encountered is that the people who work in the bureaus are overwroked and underpaid and they often will not do anything unless you take them to court. But try this first as it will cost you nothing.

If they refuse to correct this, then the only option you have will be to get a local Arizona family lawyer who does child support and take this back to court to get your arrears straightened out. Once a court order is in place, the child support folks should report this correctly and you can provide a copy of the order to the credit bureaus so that they will correct the problem.

Theoretically, an item could be stolen first, then "lost" I suppose, then received by someone else; later "losing" (losing possession of) would not negate original theft if I am understanding what you're asking. In other words if you steal a car, then leave it somewhere (abandon it or otherwise lose possession, voluntarily or otherwise) it can still be categorized as "a stolen vehicle" and you could still be charged with theft - your actions can still be interpreted to permanently deprive the owner of its use. Does it make sense?

For me, there's not enough information here to answer intelligently. Try again with more details.

The question as to whether it is worth fighting an insurer, is specific to the facts of each case. Find out how the specific facts of your case determine yoru next best step. It matters whether it is your insurer or the insurer of the other driver. If damage occurred while it was in their control (as you described the hail damage) than that should not diminish the value at all. If you have found comparables in your area, than that should bolster your figures or theirs. Tell them you will nto accept less thatn is fair and may need to consult with legal counsel. Then, if you cannto agree with them at af igure, consult direclty with an attorney in your area. If you have to sue yrou insurer for improper efusal, then you may get your attorney fees reimbursed. Courts enter judgements and then it is up to the plaintiff to collect. It is extremely rare for a Court to do a payment plan or get involved in collection (beyond the legal issues involved). The time to make a deal was before judgment was entered and if the plaintiff can get paid through garnishment they have no incentive to stop until it is fully paid.

If the judgment was vacated, you should be able to file an appropriate traverse or pleading in the garnishment to stop it (although they probably will file a new one).

Courts almost never do payment plans unless the parties agree to one, so your time to work that out was beforehand and not now. With a pending garnishment the plaintiff has no incentive at all to stop and wait for you to pay later.

You can't petition the court to do what you want. There is no procedure for that in Georgia like there is for some other states. The time to work something out was pre-garnishment. Then you could have worked out a payment plan pursuant to whcih they would agree not to garnishm as long as you made your payments.

Sounds like there was a clerical error - judgment was supposed to be for $850 not $8000 so this was fixed.

The creditor can only garnish for 180 days. They can renew, but maybe before they do you will be able to get funds together to get this resolved.

There is no Probate needed (no car, home, or solely owned possessions). His 3 credit reports show no outstanding loans or creditors. His will requests that all assets be split between me and my brother. Can I just change the accounts to my name and distribute the monies to my brother as my father wanted without Summary Admin, etc.? It seems cut & dry? Thank you.

If the TOD accounts are to you only, you should have no problem. If you have assets that you are to split between you and your brother - then you may want to consider a short administration in the event that a stock will not transfer without a court letters.

Since it appears that all assets were jointly owned, or TOD, then no probate required. Also the Will has no effect on them, and they transfer in accordance to the account.

Finally April of last year we told her we could not do it anymore and she would have to move. We were shocked she was upset with us and said family does not do this. There is no Federal renter's credit so there is nothing that the IRS, as opposed to the Franchise Tax Board, will hear about. Even if there were, few returns are ever audited. You appeared to have under reported your deductions. That you do not have a rent paying tenant in the units does not mean you can not subtract any HOA fees or other expenses you actually pay for. Had you merely had a tenant who left and it took a month to get another renter in, does your tax consultant claim that you could not deduct as an expense for a rental property the amount of home owners monthly payments made? If so, fire that person as they do not know the law.

As for Kathy, ask, with the Aunt listening in, whether she really said what it is claimed she said -- i.e. that she committed tax fraud. you will then have to decide whether you want to inform the tax authorities of that.
