If I understand the question correctly, I can say the main reasons for its popularity in the Western World is its brevity, the flexibility of the form we have allowed ourselves to use and the resulting ease of composition which the form as practiced outside Japan allows. No, not because of that. Once the person becomes a resident of Florida, their out of state Will can still be valid if it complies with Florida law. Otherwise it would be invalid.
Simply put, Florida basically requires 2 witnesses, that they sign at the end with the Testator/Testatrix, in the presence of each other. Some states only require 1 witness or no witnesses, so their Will would not be valid in Florida. To know for sure, the Will should be examined by a qualified probate/estate planning attorney.
In the long run it may be beneficial to make a new Will in Florida to avoid potential problems such as this.

Accept the fact that they will sue you and obtain a judgment against you. However, they cannot garnish your wages or seize funds from your bank account in South Carolina. The judgment will negatively affect your credit rating and be active for ten years. If you own a home the judgment will place a lien on your house for the amount of the judgment plus interest. So when you go to sell your home it will have to be paid off before you get any funds in your pocket. I would not lose any sleep over this.

If you mean your employer's INSURANCE required a co-pay for ob care and/or the hospital stay, that would be governed by the insurance policy and you'd need to refer to the insurance policy at issue. Sometimes doctors might have a flat fee for ob related care but that is an issue with the doctor billing and something your employer shouldn't be involved with. Otherwise, it is unlikely that an employer can make an employee pay for anything related to any medical leave, whether for a birth or otherwise.

The best answer is to obtain her work visa now, specifically an H-1B, and begin work immediately. Then she can take a vacation and be permitted to travel without having too much issue returning. The dual intent doctrine also allows your relationship to remain intact without having to rush to the alter or be hidden.

Based on what you have told us, the law seems to be on your wife's side. I might see things differently if I could read the post and the demand letter. But even assuming your wife is in the right, the doctor could take action against her. She would then have to mount a defense, which can be expensive.
Many states have laws to protect people in her position. Those laws usually provide a method to have the case dismissed and require the unsuccessful plaintiff to pay the defendant's legal fees and costs. Your wife should find out what state the doctor is threatening to sue in, and then ask lawyers in that state how she can defend herself.

If there are no potential heirs other than those that you have mentioned, the siblings are the heirs. One of them needs to open a probate and petition to be named executor of the estate. Then they, hopefully with the help and cooperation of the other two, needs to start gathering information to marshall all assets and liabilities that she died with. From there, unless there is fighting among the siblings, it is a business process. Liquidate the assets unless one of the siblings wants to buy something from the estate with their share of the estate proceeds and/or cash, pay the outstanding debts, and distribute what is left in three equal shares. All of this will have to be reported to the probate court, and major transactions may have to be approved, like sale of the house. Nolo Press has a pretty good book on how to probate an estate, and it is readily available in bookstores and from Amazon and their competitors.

In regard to someone who has died without a will, the first step is to examine how title to assets are held. If they are held in joint tenancy, then you can transfer the assets without probate by using affidavits. Likewise, if there are beneficiaries designated or payable on death clauses the asset will be transferred automatically to the person so designated. If property is held only in the name of the decedent with a value or more than $100,000 and/or if there is real property involved with a value of more than $20,000, you must initiate a probate petition.

Based on your statement I am to assume your are a male and have been denied a specific shift due to the fact you do not have breasts. The act of refusing specific work based on a persons gender would in fact be considered sexual discrimination. If an estate has real property, and you are administering a will, I'm supposing that you are operating within a probate proceeding. The Probate Code provides (section 11004) "The personal representative shall be allowed all necessary expenses in the administration of the estate, including, but not limited to, necessary expenses in the care, management, preservation, and settlement of the estate."
I believe that you should have your own lawyer, and probate-related attorney fees are largely regulated by statute at quite reasonable levels. Your attorney could assist you with issues such as the mechanics of dealing with the heirs and making your reports to the court, as well as how to accumulate and present your expenses for approval and reimbursement.
Finally, this is not primarily a real estate and real property question, and you will probably get better-informed answers if you re-ask your question as a wills or administration of estates question on LawGuru. Questions are farmed out to lawyers based on legal specialty and the average real estate attorney doesn't know the ins-and-outs of probate.

One night about 2 in the morning at the end of December I pulled into my driveway of my house, only to be confronted by a Police unit who pulled up in front of my driveway as I was parking my car. He confronted me to investigate an indecent exposure report that he said just happened north of me at the Park about 1/2 mile from my house. He said me and my car fit the description. After running my past arrest record he saw I had been arrested before for the same crime. They felt convinced I was their man so they arrested me. I told them I had just come from my work and I had two witnesses alibi of my whereabouts. They did not care. They released me on my own two hours later after booking me at their station. I showed up for court a month later as directed and was told by the information desk there was no record of my case and court date. She gave me a search report and said I would receive something in the mail if the case was to continue. Now a few weeks later I received a court date reminder notice in the mail from F.A.R.E. telling me I have a court date Feb. 28th. The next day I received in the mail I believe to be a supeona to appear. I did not sign for anything and have not been served anything. I did not open the sepoena notice envelope.
My question here is can I just send back the supoena notice as an undeliverable and not show up in court and what would be the consequences of that action. Also what is the best course of action to take in general.

In criminal matters, if a subpoena is issues and you don't show, the court doesn't care, they just issue a bench warrant. You really don't want a warrant for your arrest. A bench warrant in the state of Arizona is only good in Arizona. Since you live in AZ, you should appear. The state has the burden. The first thing I would do in your case is request a copy of the police report, just so you know what you are dealing with. You will be able to gague the amount of evidence that they have. Just because an officer cited you doesn't mean that a prosecutor has looked at it yet and feels there is sufficient evidence to prove beyond a reasonable doubt. I suspect that the court date was miscalendared and they issued a subpoena to replace your original calendar date. Often times the prosecution will send out subpoenas when there has been a longform review of a police report and a subsequent complaint filed. I don't think that is the case here.
Look for eye witnesses that can give a description of the perpetrator. Look at the vehicle description they gave. If they said silver car and your car is gold, that is reasonable doubt. Look for the time of the call and whether your alibi is going to hold up. Advise of an attorney will be especially helpful in your case where the State's position may be very strong.

You need to hire an attorney. Multiple convictions for incedent exposure can carry very serious consequences and impact sex offender registration requirements. If you failure to appear in court for your hearing, a warrant will be issued for your arrest. This means you can be hauled into jail at anytime if/when you come into contact with any type of law enforcement. It's not advisable to remain on warrant status. As a former sex crimes prosecutor here in Maricopa county, I can assure you that sex crimes charges require a specialized expertise. I stongly encourage you to retain experienced counsel. Can't say w/o additional info. Is this a new home? Builder should have obtained your occupancy permit by the time you closed so this should not be an issue. You should call the local building department and ask why they need access. It is possible that they want to make sure that if the house was built with an unfinished basement that it remains such - many people will buy and pay for homes with unfinished basements because the permit fees are less and frankly taxes on unfinished space is less and after closing have them finished without permits...., so this may be a way for the building department to see if you "sneaked in" a finished basement. Or it may be a subdivision where there is a maximum amount of finished space was allowed and they need to keep track of it.... So w/o your calling to understand what the point is, and without knowing more about the house, can't say. However, if the builder didn't close out the building permit with an occupancy permit, that's a different story. Beyond that, building departments can gain access for certain purposes, and until you know it is a legit purpose by calling, you should have the right to first find out why. Once you do (if you can) then get back to us if you still have concerns.

Your HELOC lender may proceed to foreclosure, but may hesitate to do so based on market conditions and the present amount of equity you have on the house.
If you do not make payments on the HELOC or are not permitted to do so, then I advise you to take whatever money you could apply to the loan (if it was being accepted) and keep them in a bank account. Your lender may settle on easier terms if you can give a lump sum payment in the future.

My guess is You have a contract, my guess is that the sales contract has a financing clause in it where you agreed to obtain financing. You must make a good faith effort to secure financing... You can break contracts but there will get damages. Assuming you can return it and break the contract, you better be prepared to pay damages.....

If dependent letters were issued, then the executor has to get court permission before all disbursements. If you have reason to believe there has been a malfeasance, you can demand an accounting.

Absent anything in the judgment for divorce, you are both legally responsible for paying the mortgage, assuming you're both borrowers on the mortgage loan. The court should have made a ruling at the time of the divorce as to what your respective interests in all of the marital property was, but absent that it would be presumed to be equal. If you miss payments, your ex is going to try to claim credits for any contributions he makes toward the mortgage, arguing that once the "help" period expired, you were supposed to take full responsibility as the occupant of the property. This might not apply to maintenance and taxes. If you want to sell before the end of the u&p period, you can propose that to him, but his reluctance might be that it's not a great seller's market. If you want to buy it, interest rates are quite low now, so it would be a good time to approach him.

Even if you have proof of what you say on your proposed website to defeat a defamation lawsuit you could still be sued for interference in his business, invasion of his privacy, intentional infliction of emotional distress, harassment and other torts. He may even sue you for libel. Even if you win you will still have to hire an attorney to defend yourself. You may be better off posting your feelings and observations to a consumer website than building your own.

But, if you're an at will employee, the employer can change or end the employment as they see fit, if it isn't for a prohibited reason. Must of the prohibited reasons have to do with race, religion, nation of origin, gender, age, etc. It is also unlawful to reduce or end employment to punish a whistle blower. If you suspect that the reduction in hours was for a prohibited treason, you should consult directly with an employment lawyer in your area.

North Carolina is a no-fault state. Adultery is not grounds for divorce; it is only grounds for a legal separation. To be divorced, all you need to show is that you and your spouse have lived separate and apart for one year or more and that one of you has been a resident of North Carolina for at least 6 months. It does not matter who files first - either way, if you meet the residency and separation requirements, the divorce will be granted.
To get alimony, you have to show a financial need on your part and an ability to pay on his part. While marital misconduct would be grounds for the award of alimony, I don't know if the other elements are met. It would depend on a whole host of other factors which you should discuss with a family law attorney.
You can request that your husband pay your attorney fees but you must prove that he has the resources to do so and that you do not. Again, I don't know what your assets are. You can only get attorney's fees in connection with a claim for equitable distribution of your marital property and/or alimony/spousal support.
You may have claims for alienation of affection or criminal conversation against the other person involved with your husband. Depending on the facts and circumstances, you may be able to sue or use the threat of a lawsuit as a bargaining chip to extract better alimony/support or equitable distribution terms.

You have to hire a lawyer to file a partition action. Normally, an executor under a will is not going to have the authority to sell the home of the person who died where that home went to the children. Basically, it's a two step process; you need to probate the will, get the house in the name of your brother, sister and yourself, THEN file a partition action seeking sale. Remember you have to renew judgment before ten years in California, but may do so earlier, anytime the first time, and once no more than every five years thereafter. It is possible; you may want to make sure your record is expunged first. If it is expunged it should be as though it did not exist. That can take some time. The only alternate is to tell them what happened; being arrested is one thing, being convicted is another, and you could explain what happened. But it could affect the job offer in another way if you did not answer honestly on any job application about any arrests; falsifying a job application is a pretty sure way of not getting hired or even being fired for no other reason. Otherwise sorry there is too little information to be able to help you adequately.

In February 2009, my car started actually weirdly. While my foot was on the gas pedal for a period of time on the freeway, my car suddenly revved as if it was on neutral gear. After I released my foot and put it back on after a few seconds, it went back to normal. I took my car in to a local dealership and they changed a "computer chip."
In January 2011, this incident happened again. This time I was on the freeway for about 10 minutes when the car went into "neutral gear." I took the car into the same local dealership and they again changed a "computer chip." When I asked if it was the same chip, they said that it was not.
Again on March 23, 2011, my car went into "neutral" after being on the freeway for 10 minutes. I, once again, took my car to the same dealership. This time my car was in the shop for about a week and half because they couldn't find out what was wrong. They finally told me that a certain pin on the sensor lost tension, which "might" have caused this problem. They said they don't know exactly what caused it, but if it ever happens again, I can take it in.
Since my car is still under warranty, I did not have to pay for any of the procedures performed on my car.
Can I still file a Lemon case? These past few cases were actually very dangerous and I am fearful to drive my car now, since they might not have found the issue.

until the child is 6 years old OR weighs 60 lbs is the California state law. HOWEVER. Recent child safety research has deduced that until the child is 4 foot 9 inches, they should ride in a booster seat whether in the front seat or back seat. For safety's sake, you should wait till the child is 12 years old before allowing them to sit up front. You can also look at the Owner's Manual in the car and it MIGHT have recommended height/ages for that particular make of car. Remember to keep the child's safety in mind first.
