Your father needs to consult with an employment law attorney. His conduct, as you have described it, is very troubling. You only have your father's side of the story and I would be very concerned that this was not the first time such an incident occurred. Your father also needs to get in contact with his supervisor/boss and provide a very clear explanation of what occurred. If there was a dispute over how front desk staff were to conduct certain types of recording in the business, it should have been a matter of policy for the office and the entire company rather than your father's wishes or preferences.

This is a very serious matter that will need to be resolved very carefully.

Go online for samples of "modeling contracts". You will find several.

You will want a "release" signed by the photo model.... releasing you, your employees, company, etc. from any claim for "invasion of privacy". In this document you will want to briefly explain what you both have agreed is to be done during the project and how the photos will be used after the shoots. This document should also release you and/or your company of any possible claims for sexual harassment or imposition based in whole or in part on the taking of photos and the use of those photos.

You will also want a "license" whereby the model (licensor) transfers and assigns (without limitation or restriction) to you (licensee) all of her rights as a photo model and that her photos may be used as you reasonably deem fit.

You will also want a short contract that ways: "Model" is being engaged by employer as an independent contractor. Model understands that- as such- the licensee will not be responsible for withholding taxes or providing health, pension, or other benefits.

If you have not already done so you might want to set up a corporation to act as the licensee. You could use the corporation for the subject session and future sessions. This will provide somewhat of a safety net for you. A very legitimate purpose of corporations is to shield owners and officers from claims. I am not advising you on this. You need to discuss this with your accountant or CPA.

If it turns out that another lot owner is obstructing the easement, then the lawyer can send the man a letter and demand that he remove the obstruction. If he refuses, then you and the other affected landowners can take him to court.

The leasing office gave me a condo that they called a "receiver unit" meaning the unit was in foreclosure and could be sold. The lease states that if the unit is sold I would be given 60 day notice and could either move into another unit in the complex or be given cash to help with my move to another property. There is also an early termination clause in the lease that states that if I needed to terminate the lease early I could with 60 day notice and early termination fee that is equal to one month's rent. I am buying a house and submitted notice on Oct. 4 that I would be moving on Dec. 4. On Oct 29 I received notice on my door from an attorney that the unit had sold and that I had 90 days to vacate. Since I was already moving, that is not of concern. However, When I called the attorney they said the HOA never held title to the unit to rent. So now my question is, am I still legally obligated to pay the early termination fee since I would have had to move before my lease was over anyway?

In at least one California case decided at the Court of Appeal, the Court held that "adjoin" does not necessarily require physical contact of borders, but can also mean simply "nearby" if that was the intent of the party or parties that drafted the language. In this case, the Court held that whether "adjoining" requires common borders or can simply mean "nearby" depends upon what the parties who wrote the language had in mind. Kai if there is litigation, if he/she hasn't already, so I'd recommend looking up the case and figuring out how a trial court would (or might) interpret the CC&Rs;in light of the holding therein.

Anything in your father's name at his death should be included. Anything that was transferred prior to his death wont be included and that is where assets could disappear.

My brother and mother own a house in New Jersey. Upon her death, I will aquire 12.5% of the house. Is their a way to force my brother to buy me out or to sell the home? We don't get along and the house has torn our family apart. I want to make sure that I walk away with something. He doesnt want to sell the house and wants to continue to have it in the family and have it pass on with generations. I want nothing to do with the house anymore but want my share. What are my options so that I get my percentage/potion financially?

You should immediately verify how title is held. If it's Jointly owned by your brother and mother with rights of survivorship [JTWROS] then your brother could own 100% of the house when your mother dies. If it is owned equally as Tenants in Common, then your mother's estate will own 50% and presumably, you would be entitled to some % of this portion [I would need to see the will to know how much].

At your mother's death, your best option is to have the house appraised, and ask your brother to buy you out. If he refuses, then you will need to bring a partition action in court. That will force him to buy you out or force a sale of the house. This will be expensive for all concerned, and will take time. You and your brother are well advised NOT to let it get to that point.

There is a court procedure called a "partition action" which requires the sale of real estate if the parties cannot agree on a buy-out procedure. This is often costly and lengthy. In your particular case, however, this cannot be done at this time because your mother is still alive. Further, you are operating under an assumption that you will receive an interest in the house when that may not be so, depending on how the current deed reads. In order to avoid difficulties in the future, you may want to discuss this with your brother (and anyone else involved) at this point. It will only get more difficult after your mother passes away.

Keep in mind that this advice is given based on the little bit of information that you have provided in your question. My advice may change based on other information. I believe it depends in many cases upon the history of the public right-of-way, but there is a provision in the California codes, I think in the Streets and Highways Code, that gives ownership of the mature trees growing along a public street or highway to the public agency that owns and maintains the road. Sorry, that code isn't one I have in my library. However, I am certain that "my" trees growing in front of my house are really owned by Marin County, even though my property line technically extends all the way to the center line of the road! Kind of a surprising result, but it's handy to know that when a winter storm causes large limbs to fall into the road, the county has to come along and clean it up - and, I suppose, if there were an accident, the county would be liable. So, I think your first proposed answer is most likely to be correct in most cases.

The lady did not know what she was doing. She did not give me a receipt of the deposit until 11/4 that they received the 200..tried making me sign the paper as of 9/11 but i refused... and signed it on 11/4.

Two people looked over my file and said they will let me know when they send it to compliance...I passed the backround and credit so I am prequalified which is I am accepted and had an apartment number 327.

I told them how I fewlt that they were disorganized and put my file on hold instead of calling me to let me know beforehand that they needed some things from me...bypassed my file to work on other files.

11/9- I get a phonecall saying I am disqualified for the 30% unit . That my bonuses and my pay were not calculated correctly from thew beginning and my bonuses of 200 I get on my paycheck make me to the 40% bracket. Now I need to take the 40% and I will not get my holding deposit because I am "BIND TO Agree to get the 40% .I told the landlord that the rent for the 40% is too high I cannot afford it. The holding deposit is to hold the rental unit for a stated period of time until the tenant pays the first month's rent and any security deposit.

I'm a part owner in a company that is effectively shut down. The majority owner has been trying to sell the company and any sale would require a 2/3 majority approval (which he doesn't have). Now he is saying he is creating a joint venture with another company and as part of the agreement he is giving the ONLY asset the original company has to the new joint venture company. Can he legally do that? It seems to me like it's a way around getting approval to sell. No money is supposed to be changing hands as a part of setting up this new company, but the process of creating the company means that there is no opportunity to sell original company because the only asset has been given away. The original company will be a 50% owner of the new company but it seems like my value has been cut in half.

What your partnership agreement (or bylaws) actually say, will affec your otions. You dud not state the value of the otter entity. Perhaps you now own a smaller piece of a larger pie. If not, you may only have a short time to have a Court intervene. Therefore, I suggest that you consult deftly with a business law attorney, soon. Probate filing in California is $2500, publishers are offering nowhere near this amount. So what happens to the copyright if the asset is not probated, and do any new monies have to stand for the old debt which is now probably outside the statute of limitations for collection?

The billing company who processes our monthly dues told me that all of the June payments were returned back to the business. The buisness got our money. The gym gave telephone numbers to contact for a refund that was posted on their buisness window front but all calls to the owner have not been returned.

Is this something that be handled in small claims court, since the business is still operating but in another state? There are over 100 to 200 people that got screwed out of money. Can a large group proceed as one plantiff and sue this company together?

You should have a local real estate lawyer help you to make a claim for the property or at least for the value of your maintaining it and improving it. You need to move on this fast, because if the property is sold and you haven't filed a claim so that there is a recorded record of it, you will not get anything.

You can stay in the house, because he would have to go through a legal process to make you move. If he does sue, you can assert your claim then. If there is a buyer of the house, the buyer must have visited the house and would know that you live there, wouldn't s/he?

However, just because something is illegal, doesn't mean it doesn't happen. If you have no obligation to alert him to your pregnancy, and normally you would not, don't say anything. The opposing party, however, did not serve opposing counsel with notice of the petition (via email) until 2 days after it was filed. Per Cal R. Ct. 8.487, the respondent has to file a preliminary opposition within 10 days of the filing of the petition. However, we have now lost two days we would have had to work on the preliminary opposition due to opposing counsel serving us two days after filing. Do we have to file opposition 10 days from the date the petition was filed or 10 days from service of the notice of petition? It does not seem fair for us to have to respond from 10 days from filing, since we weren't notified until 2 days after that. We are in California Superior Court. The petition was filed in the appellate division. Thanks.

You're looking at the wrong court rule. California Rules of Court, rule 8.487 governs service of opposing and amicus briefs in the Court of Appeal.

If you are involved in a limited civil action in the Superior Court, then appellate matters are handled by the appellate division. You mention the "appellate division" so I assume that you are involved in a limited civil case. Filing an opposition to a petition for a writ of mandate in an appeal to the appellate division is governed by California Rules of Court, rule 8.933. That rule provides that an opposition to a writ petition is due within 10 days after a petition is filed. http://www.courts.ca.gov/cms/rules/index.cfm?title=eight&linkid=rule8_933

The time frame is similar, but if you are dealing with a limited civil case, you need to be careful as the rules sometimes differ between the Courts of Appeal and the Appellate Divisions.

But it is also subject to Rule 8.817, which says that any document filed in that division must be served *before* it is filed. It seems your opponent violated that rule.

You say that the papers were served by email, but service by email is usually not allowed. Did you and the other party agree in writing to allow email service? If you didn't, then you probably still have not been served properly.

Did the petition include a proof of service? If so, what did it say? If the proof of service was missing, then the petition should not have been filed. And if it was falsified, you should let the court know.

Even if you don't file a preliminary opposition, the appellate division will not grant the petition unless it first issues an alternative writ or an order to show cause, or notifies you that it is considering granting the petition. Once any of these things happens, you will have 30 days in which to file a formal opposition. Note, though, that the court might grant a request for a stay in the meantime.

I got arrested on 12/19/2013. My court date is on 12/31/2013.

I was with my friend on abandoned property (we were trespassing) and we were literally just walking around. We get back to the car after 20 minutes or so (friends driving, I'm the passenger) and before we get to leave a police officer pulls up. He said the car smelled like marijuana, even though we hadn't smoked, and asks if we have anything. My friend had a grinder and a one hitter and gave him it, and then he asked if we have anything else, and asked for permission to search the vehicle or he will bring out his K9 to smell it. So my friend told him there was a bag filled with another grinder, a jar, rolling papers, but no weed (just residue) in the trunk and gave him permission. The officer then also found two roaches (marijuana blunts) in the car as well. My friend said it was all his (and it was technically) but the cop proceeded to arrested both of us. I'm 20 years old and he's 18. We hadn't smoked anything that day. I don't know if this matters either but the cops never read us our miranda rights before or after arresting us.

So my questions are, should i plead guilty or not guilty? Should I get a lawyer or a public defender? What do I do? I'm feeling a little overwhelmed and lost, and I don't have a high enough income to really afford a lawyer. To anyone that answers, thank you for your help.

Extra info: The police officers criminal report said we had 3 grinders, we only had 2. I don't know if this makes a difference but it is wrong.

However, the negative impact on your credit score may, but that would be up to the issuer/servicer of your credit account. Further, if you were to file bankruptcy in order to avoid a deficiency judgment, then you would lose your credit cards, at least until after the discharge of your Bankruptcy.

If you didn't do anything wrong, the person may not be a police officer. I've heard of this fraud before. I hope you didn't give him any person information (account number, date of birth, social security number, etc.).

You can always call the bank to determine if it's a scam. If your account hasn't been closed by the bank, it is unlikely the bank filed charges. I've heard of this scam before by another poster.

If you are concerned, contact a local criminal attorney to act as a go between and obtain information. I would strongly recommend that you don't talk to this person again without an attorney.

Most contracts have a paragraph where it sets out when you have to have the inspection by, when you have to notify the seller if the inspection discloses problems, what the process is to allow you to negotiate with the seller as to what repairs he's willing to do or not to do. There's usually a time limit in the contract as to when you can tell the seller "We haven't come to an agreement as to the repairs, so I'm cancelling the contract. Please send me the deposit". If you missed any of those dates, or didn't give notice in a timely fashion, you may lose the deposit. Did you have a real estate agent? He/she should have been keeping track of those deadlines.
