Maybe. Maybe not. You haven't provided enough facts.
If you had no reason to know he was there and could not reasonably have seen him before you hit him, then you probably aren't liable. But maybe you could have seen him and didn't because, say, you were looking at something else or didn't have your lights on. Or maybe you had seen him passed out there earlier and just took it for granted that he was gone. Or perhaps you had piled up your belongings in a way that unreasonably obstructed your view.
It may also matter why this man had access to your garage. If you invited him in you are more likely to be responsible than if he was a trespasser.
There are plenty of other reasons why you might be liable, and plenty why you might not. You should consult with an attorney and explain the details of your case.

It's hard to offer any guidance, since you haven't told us what the case was about, why you think someone committed perjury (or even who it was), or what beliefs you feel were the actual basis for your husband's conviction or sentence.
You also haven't said when any of this happened. Your husband may be able to bring post-trial motions and/or file an appeal, but there are deadlines for these things and I can't say whether they have already passed.
Has your husband's lawyer explained why he is unwilling to take the steps you feel he should take? Since I don't know his reasons, I can't say whether I agree with them.

I agree with my colleagues. There is way too little information for me to try to second guess his attorney. But you have got to understand that not all lies affect the guilt or innocence of the defendant. Likewise not every act of police misconduct will affect the defendant's guilt or innocence. Not all "proof" of perjury is sufficient to convict a person of perjury beyond a reasonable doubt.

I am a small business in California. I entered a 12 month service agreement with an interent marketing company to provide SEO services (to be found all over the internet). The company automatically withdraws form my bank account on a monthly basis. At the time I signed the agreement, the sales rep did NOT state that it automatically renews. I found this out when my online checking notified me this month (being the 13th month). I called the company and they said that on the contract it does state that unless I notify them within 30 days of the end on the 12 th month thay will renew me for a full year unless at this point a written notification is now a 90 day reuirememnt. Second, (this part is not sour grapes or buyer's remorse) my company has a near zero presence online as I am not "found" on Google, Yahoo or Bing, rather, only on two obscure out of state online private business directories. I would simply like to cancel without giving into their unfair demands. What is the law in this regard? Your reply is most appreciated. Thank you.

A contract does not automatically renew. It is essentially a new contract which your acceptance is required, and your inaction in cancelling does not constitute an acceptance. After the term ended the contract ended and you have per your monthly payments a month to month informal agreement. Give 30 days notice.
About their poor performance you ought to see what they promised to do for you in the contract. In my opinion SEO "services" are a joke and is the latest gimmick web related companies use. If they didn't even have access to your website you bought next to nothing other than having someone someone submit your website url to a directory. SEO services from a webhosting company usually offer to edit your website's data tags, snippets, robot files, etc. which is what this company should have done. In my opinion that it like using a bucket to empty the ocean, it ain't going to do anything. You ought to have your webmaster look into Google Adwords.
Check the contract for what they promised and see what they actually did. If they didn't do what they promised then just take them to small claims court if the amount is under 10K.

It sounds like you have two issues: (1) a termination of the contract; and (2) a failure of the SEO company to deliver services.
I would need to review the contract documents and speak with you personally to get a feel of the enforceability of any automatic renewal provision, and to get a feel for any claim of breach by the SEO provider. Indeed, it may be that you have a claim for misrepresentation against this company, based on things the sales rep did and did not say. It may be that you should issue a demand letter for the termination of the contract and/or recovery of amounts already paid.
Small claims court is an option if the amount in question is less than $10,000.

This differs somewhat from the above. Automatic renewal clauses are valid in California with some conditions. An automatic renewal clause allows an agreement to continue for a defined period if the existing agreement isn't terminated (or renegotiated) within a specified time of the expiration of the current contract. The term of renewal depends on the specific contract language, but generally is for the same period. However, California requires that automatic renewal provisions must be in plain, clear English and in at least 8 point bold faced font to be enforceable. If this is not the case, then send a certified letter to the same effect, and that you are terminating the contract. If this is the case, negotiate the best termination settlement you can, and get it in writing.

No, you are not legally married, at least not under Oregon law. The marriage to wife #2 was void from the beginning because you were still married to wife #1. Passage of time does not legitimize a marriage that was void from the beginning.
To fix the problem (now that you are legally divorced from Wife #1) you need to get married to Wife #2 all over again. That will make the second marriage legal and legitimate.
PS: Don't forget to buy Wife #2 a new ring. That also will help fix the problem. :-)

If your fiance entered the country without inspection, he will have to apply for his green card at the U.S. Consulate in Mexico with a waiver of his unlawful presence. The waiver will have to demonstrate that his U.S. Citizen/LPR spouse or U.S. Citizen/LPR parent would suffer extreme hardship if he were not able to return to the U.S. These cases are very fact-specific and you should speak to an immigration attorney to determine whether he has a strong case. If he is denied a green card he would be barred from reentering the U.S. for 10 years, so it is important to file a strong waiver.
Another option that may be available to him is adjustment of status under 245i. If a petition was filed on his behalf before April 30, 2001, he may be 245i eligible and able to apply for a green card while staying in the U.S.

First you have to determine the court of continuing jurisdiction. If the last order involving your son was signed by a Texas judge, then Texas is proabably the court of continuing jurisdiction. If that's the case, you can file a motion to enforce possession and access or a motion to modify the parent child relationship.
If the last order was signed in GA, then you need to take action in GA. Even if Texas has jurisdiction, your ex may file a motion to transfer the proceedings to GA and the courts will permit that because that's where your son lives.

Well... this takes me back to 1973 when I was an apprentice... OLD cars didn't have water pumps so they relied on convection to cool the water in the radiators. They had to be tall and worked on the principal that hot water rises and colder water falls. The header tank on top of the radiator was higher than the engine and as the water went around the engine it heated up, then it entered the radiator and fell to the bottom, all the time being cooled by the air passing through the radiator. As technology improved, water pumps were installed so bonnet lines could be lowered making a more streamlined shape. Look at Chitty Chitty Bang Bang compared with a porch 911 to see what I mean.

You have a right to get paid. In bankruptcy court you should get classified as a priority creditor. This means that you should get paid ahead of any unsecured creditors. You also may have a claim for vacation time that perhaps has to get treated differently in the Chapter 11.

Before the first payment came due, they defaulted because they thought we had a certain client. After a couple of days of discussions, they realized they had misunderstood, they asked for a new contract with an extended term, and a smaller payment. So we re wrote the contract. They then made the next 2 monthly payments. (That would be February and march payments) they then defaulted again stating they didn't know we didn't have that client. So we have filed a breach of contract against them. They then went and filed bankrupcy to try and get out of this, but they are still running the business. We have filed to get the debt they owe us non dischargable, but our attorney is not real knowledgable with bankruptcies. The defendants keep saying they didn't know we didn't have that account, but remember, they resigned the second contract. Also, she was our CPA and knew everything about our company, including our financial status and our clients. Also, this business is all proprietary techniques. What does this mean: "We have filed to get the debt they owe us nondischargeable." Your attorney should have filed an Adversary Complaint to have the debt declared nondischargeable within the legal time limit after they filed bankruptcy. Unless this was done correctly, you are stuck out of luck. If you hired an attorney to do this, and the attorney didn't do it correctly, you could have a lawsuit against the attorney. There is also a legal time limit for filing legal malpractice lawsuits. If you send me the bankruptcy case number I will look it up for you.

When you were in court 2 years ago, child support guideline worksheets should have been prepared which would have determined which parent had to pay support to the other. This is based upon a number of factors--respective incomes (before taxes), child care expenses, health insurance costs, and uninsured medical expenses. Generally such things as extracurricular activities aren't part of the calculation. However, a judge can adjust the guideline amount within a certain range if appropriate. If over the past 2 years there has been a significant change in income for either of you, there may be a basis for modification of the 2 year old order. If your ex is violating a specific court order to reimburse you for the expenses your 8 year old is incurring, then you would have the basis for seeking a contempt order. You should schedule a consultation with an experienced family attorney who can review your specific numbers re income, etc., and determine if there is a legal basis for adjusting the amount of support, or if your ex should be paying more toward your child's expenses.

You don't say what "public record" it appears in. Generally an office lease is not recorded in the land title records at the county recorder's office, which is usually what is meant by "the public record." If a memorandum of lease was actually recorded with the county recorder, then there is most definitely no way to remove it and there would be no reason to do so. The county recorder's records are a running log of transactions that affect rights in real property. Once a transaction happens and is recorded, it has happened and it is of record. It doesn't go away. You can't un-ring a bell, as the saying goes. However, it also doesn't directly affect anything, unless there is some dispute or other issue that comes up about rights in the property in question. It is just a record of a transaction having occurred.

Clients have attorney client privilege and attorney client confidentiality when speaking to an attorney, so after I explain that and a client continues to lie to me, I figure it is a red flag and try to get rid of that client as soon as possible.

20 yrs of my life has been ruined by Dr's sending me home with excuses like.Probably nutritional,need exercise.I once was even told,"I think your more well than you think" I never went in for bites,rashes,cuts,colds,etc. I felt ill half time,and had had pain.And really struggled with life in general ending up depressed etc. Which only made matters worse,as far as the way I was being treated. Long story short..Some of the pain I complained of which made me turn white,drop to my knees,and start sweating.Turned out to be a pedunculated tumor on the outside of my uterus.That was adhered to my kidney,and intestines.Hours in surgery,and a week in the hospital.This took a few yrs. I felt tired and il. Yrs I went in saying I think I need some thyroid medicine.(almost everyone in my family has thyroid disorders.Mother,sister,brother,aunts,cousins etc.)I was told that didnt mean I did,because I had normal labs.Yrs again. Then I started having heart trouble etc. So they focused on that. Finally, when I didnt feel better after heart medicines etc. Losing have the hair on my head,and scars up and down both arms as my system couldnt heal anymore. They did a radioactive scan with dye.It came back Hypothyroid. Its a fact that 20% of persons with Thyroid disease can have normal labs.I kept having neck pain,and pressure in my head.Some days making me dizzy,foggy etc.They looke up my nose with a light and said you're fine.Went an ent. which they did find a problem and said I needed septal surgery. Did that felt somewhat better,but soon was back to square one.Then was told lets try ear tubes.Did that didnt help.I kept complaining of my neck being stiff and hurting.They took and xray and said its fine and sent me on my way.Was zat the dentist,telling them my neck and jaw hurt..They DiD want to help,and wanted me to see the maxiofacial Dr in the Tmj clinic..But needed a referal,which the Dr refused me.Because he said they already delt with that and its probably arthritis so you don't need one.I repeatedly mentioned,It was hard to swallow sometimes,couldnt laugh because I would start coughing/choking. By now I'm getting treated like an idiot everytime I went in.I mentioned this to the Dr,2 Ent's,and more than a couple dentists.Even got mad and told them to look in my Damn chart and see that I dont come in for colds,rashes little things etc. and never have,Something is wrong.Nope sent home.Finally the side of my face swelled up (this went on for 10 yrs) and I went to ER. I was told it was a salivary gland infection,given antibiotics,and sent home..Followed up with ent who looked in my mouth felt my glands lightly and said "use hot packs and massage".Sent me home..AGAIN 2 weeks later at the dentist,I mentioned it Again, and explained the ER trip etc. I had a wisdom tooth that was in an odd position ans asked if it could possibly block any drainage that need to happen..They said possibly, Pulled the wisdom tooth and low and behold there was infection, which had spread through my gland system,and also in the spaces of my etc.I told them I only had 3 days of antibiotics,and really should have another scrip because of the extent of the infection.Nope , I was sent home,and it was mentioned it'll be interesting to see what happens over the next couple weeks with that tooth out..right, soon as the antibotics were gone my face started to swell..Called and spoke to the nurse who just said "Oh that is serious,you have to come in" I said " I was just there last week""They "know there's infection,and 3 days left,they should have given them to me then,Its an hour away,I just need antibotics to get this gone" I asked her to just go tell the DRS that pulled the tooth, she refused. I got so freaking mad, I went and got my own antibiotics,and am still on them as I'm typing this.I again have about 3 days left,and hope I got it all. These were minor health/dental issues that could have been remedied very quickly and easily without the need for surgeries etc. It should not have taken the last 15-20 yrs, and all the pain and suffering I had to go through.This has affected my ability to work,go to school. Have a life..Its affected my relationship with my family,as I always sick..I have missed so many things in life.I'm now 54 yrs old, my husband has developed a fear over the years that he'll wake up and find me dead next to him.He too is very angry and frustrated.And I'm still worried about the outcome of this current issue..I failed to mention that due to of course my limitations with work etc. I was on the States pre paid insurance plan.Which everyone knows as soon as anyone sees your on that you immediatley get treated differently,even tho they deny it..I am not an idiot,and have an IQ in the hundreds.I am not a hypochondriac.My medical record would show maybe one sinus infection,everything else is related to these things that I ended up finally getting help for.But only after yrs, much pain and suffering,and by then they caused more problems than needed to be.Not to mention the yrs of my life wasted. GETTING CALIPER & NEW PADS ON ROTOR I'M NOT exactly sure what you're asking but I think I know. Here goes: I think the problem you're having is that you can't get the caliper assembly (that the new pads sit in) back on, over the rotor. This is because as the old brake pads wore down, the piston inside the caliper moved closer to the rotor. What you need to do is take the new pads out of the caliper assembly. In the center, you will see the round solid end of the piston. What you have to do is get the piston pushed back into the caliper. Try using a LARGE "C" clamp. One side of the clamp on the caliper backside and one side of the clamp on the piston side. Carefully squeeze the clamp together, and the piston will very slowly go back into the caliper. Keep squeezing it until the piston goes all the way back in. Now when you put the new pads back on the caliper, there should be enough room between the pads to slide it over the rotor.
