I am muslim middle eastern physician, law legal resident for 10 years. At my current job, after the my boss who hired me left the company. I was moved to another team, where they progressively diminished my position. Took away the office and moved to cubicle (as I don't qualify anymore) all other employee of same title has offices. They didn't let me go to annual meeting in Europe as there is high likelihood that my visa will be rejected. When I complained, one coworker said that I look like terrorist.

I feel target, disrespected and discriminated. This is multinational biotech and employees all over the world and they treat me unfairly.

Can I file a suit?

It is unlawful to discriminate against or harass an employee because of his/her religion, etc. If the company did not let you go to Europe because of visa issues, then I don't see how that could be considered unlawful discrimination. The "terrorist" comment is inappropriate and may lead to a case for unlawful harassment if there has been similar conduct which is either severe or pervasive. One comment alone won't make a lawsuit. You should complain about the "terrorist" comment to HR if you have not done so already. If discriminatory or harrassing conduct relating to your religion, etc. continues, call an employment law attorney.

One peer comment is not 'proof' that you are being discriminated against by mgmt. It does raise your suspicion though. To win any suit, you would have to prove the conduct was all "motivated by" a discriminatory attitude towards you, and you would have to overcome the company defense that you were simply suffering from poor evaluation of your performance and value to the company. Without direct evidence such as comments about race or religion being a factor, jokes, etc, you have only circumstantial indication of discrimination. So, what evidence DO you have? Let me preface by stating that I am concerned that you feel the need to make the effort and post your specific questions here and not simply pose it to the lawyer that you already hired to prepare your application. Perhaps it is some non-lawyer website you are working with and they cannot answer your specific legal question? If so, this can be a big mistake.

An initial rejection by the Trademark office can be overcome through several methods, but they each have tradeoffs and consequences. For instance, a disclaimer of specific words in the mark may allow you to register, but you would not later be able to enforce your rights against others using those words in their mark. Another offer is for your mark to be registered, but on the "Supplemental Register" which similarly does not offer you any legitimate protection against would be infringers.

A corporate name filing is separate and distinct from a registered Trademark. The Secretary of State's office may similarly reject your application if there is a name conflict. That rejection will not be overcome by disclaimers or other means. I always recommend business owners obtain their LLC and then seek your Trademark or other contracts/debts once protected behind the LLC.

In the New Testament the apostles translate this spiritually in accordance with Isaiah 53:12, "because he poured out his life in death". So "blood" signfies "life" and to partake of the symbolic wine means we are participating in Christs life which "he poured out unto death".

Jesus commanded his followers to remember Him by eating bread (His body) and drinking wine (His blood) until He returned. How can we remember Jesus by eating literal bread? We remember Jesus when we eat spiritual bread (His words) and when we share his bread/words with each other and participate in His cup/life. The idea of rituals is that the symbols used are like metaphors in which the meaning is completely transferred. There is no magic in rituals (only spiritual truths in what they teach us to do).

The Bible often refers to eating Gods words. One must digest and internalise that which is eaten. Then that which gives life will become a part of your body. As you get new understandings, the new will replace the old, "no one can enter the kingdom of God without being born of water and Spirit." (John 3:3-5) the vessels full of water will be changed to vessels full of wine (symbolic of the life or spirit of Jesus); as were the vessels of water in Kana.

In the Bible natural things are used to represent spiritual things. So just as we need natural bread to live naturally, so we need spiritual bread to sustain us spiritually (the words/teachings of Jesus).

So instead of doing a literal ritual in which we literally eat bread and literally drink wine the ritual is actually telling us to...

1. Eat the (words) of Jesus who is "the Word of God" Jn1.1 (study, internalize and digest the Bible)
2. Drink the wine or participate in the example of His life.

Jesus is the "bread of life" and the "Word of God". In the Christian ritual the bread represents spiritual food, "I am the bread from heaven" (John 6:51). Jesus said and He is "the Word of God" (John 1:1,14). So to eat Jesus means we are to eat spiritual bread which we are told are his (words/Gospels).

Eating Gods words was a common Biblical idea (Jeremiah 15:16; Ezekiel 3:1). So to consume bread represents eating, digesting and internalising the words of Jesus. "the words that I speak unto you, they are spirit, and they are life." (John 6:63). So the bread represents spiritual food (His Words) and the wine represents the example of His life. To partake of the cup; "the words I have spoken to you they are spirit [bread], and they are life [wine]".

Wine signifies blood, and blood signifies life "the life is in the blood" (Lev 17:14) and Jesus "poured out His life unto death", which means He surrendered His natural human spirit/life, to do the will of the Father (to be led by His Spirit) which was "in Him in all fullness", as a cup full of wine. So likewise, when we partake of His cup, it symbolically means we are partaking of His life (walking as He walked), living as He lived (to be led by the Spirit of Christ) "if any man will follow Me he must walk as I walked", "if any man will follow Me he must deny himself". The same will be granted with a crown of immortality, which is what these words symbolically mean "Except ye eat the flesh of the Son of man, and drink his blood, " (Jn. 6:53).

HIDDEN BREAD
"He that hath an ear, let him hear what the Spirit saith unto the churches; To him that overcometh will I give to eat of the hidden manna, and will give him a white stone, and in the stone a new name written, which no man knoweth saving he that receiveth it."

Jesus obviously spoke symbolically, phrases such as "born again" (John 3:3), "living water"; "destroy this temple and I will raise it in 3 days", as the whole Old Testament was written in such a way but the natural man (Pharisees) could not perceive it as the Churches cannot likewise today. "And He opened their understanding, that they might comprehend the Scripture" (Luke 24:27,32). Therefore, to make an Idol is to materialise spiritual mysteries. The Priests, then, were Idolaters, who coming after Moses, and committing to writing those things which had been delivered unto Israel, replaced the true things signified, by their material symbols which perpeutuated ignorance, and those who trusted in them went into [spiritual] captivity through the continuation of meaningless rituals (externalised) "due to lack of [spiritual] knowledge" - like animal sacrifice taken literally and not spiritually "your burnt offerings are not acceptable" (Jeremiah 6:20); Isaiah 1:11-15 "To what purpose is the multitude of your sacrifices unto me? I am full of the burnt offerings of rams, and the fat of fed beasts; and I delight not in the blood of bullocks, or of lambs, or of he goats Bring no more vain oblations your hands are full of blood." The animal sacrifice was about sacrificing the animal nature in us. That is why Abels sacrifice was accepted, he made a LIFE sacrifice (i.e gave up greed, lust, desire, pride), the same basic motivating principles we share with animals, which we are to rise above.

Jesus is the "bread of life" and the "Word of God", the shewbread inside the temple has this meaning. The word shewbread or lechem paniym is literally the bread of presence. God uses bread to symbolise or speak of His presence. God's presence is experience in obedience to His Word, which is also Himself. The comparison is literal bread that gives life to the body, with the bread of God (the Word of God) which gives life to the soul and spirit. The unleavened bread upon the table of shewbread in the temple (human body) symbolizes the "logos" Word. The Holy Spirit is the spiritual light inside the tabernacle (the candlestick). It is the Holy Spirit who enlightens us. The golden candlestick was set "over against the table" (Ex 26:35) which means directly across from the shewbread on purpose so that His (God's) light will directly illuminate the Word of God as the New Testament also tells us represents the Holy Spirit. Together, the Holy Spirit (candlestick) and Jesus (shewbread) are the "rhema" Word of God. "The Word (logos) was made flesh, and dwelt among us." (John 1:14).

Interestingly in John 6:66 the reason why the followers of Jesus walked away after hearing this is because they could not understand it was symbolic, not literal "From this time many of his disciples turned back and no longer followed him" (Jn 6:66). This is the reason most people also misunderstand the Bible today. In ancient times the style of writing was to try and cause offense in the literal sense in order to (force) the reader to interpret a riddle symbolically and the Bible is a book of symbolic riddles. This is how riddles used to be written in ancient times, we call this an intentional paradox, "Aware that his disciples were grumbling about this, Jesus said to them, "Does this offend you?" John 6:61. In other words it was supposed to sound offensive in the literal sense to force the abandonment of it and the search for the symbolic meaning. The Bible often parodies paganism in the literal sense to subvert it in the metaphorical. The most obvious example is blood or animal sacrifice, a continuation of a pagan idea which the Bible parodies to subvert symbolically (i.e represents sacrificing our own animal nature within). All rituals have their meaning metaphorically or allegorically and are intended to be internalised (applied spiritually to us). Jesus had to fill the jars with water first before He changed the water into wine. As He teaches in John 2 "man is first born of water and then spirit" signified by the wine to become "vessels acceptable to God"; "full of the Spirit" of His life and truth (represented by the wine). This is why John 2 says the jars were "keimenai" = lying down. meaning a dead man (a man being asleep - spiritually) - being raised from the dead to be taught by God.

It is the symbollic meaning of the Lords prayer "give us this day our daily bread". Not natural bread, but spiritual bread (the words of Jesus), the Words of the Gospel; "my words are Spirit and they are life". To consume the Word of God is to internalise/digest the words of Jesus.

However I sufferred two seizures and my memory was severely afffected. I couldnt remember anything that happened at the hospital and because of my irregular behavior and loss of memory the hospital recommended that a caregiver take care of me until my I regained my mental faculty. It is twelve after my court date and I just regained some memory and I checked my court date and saw that I misssed it. In the minute order the court wrote that the bond was exonerated. Does that mean I shouldnt worry the bond anymore because I just sent them the minute order which explains that the bond was exonerated. Please tell me what I should, I have all the documentation from hospital which I am guessing the court will was to see. I just want to know what to if the bond is exonerated, and finally what happens in this situtation what happens in this situation. Thank you

You shouldn't worry about the bail. It was exonerated and it's a non-issue. You were released on your own recognizance when the bail was exonerated, and you remain so. However, your failure to appear may have caused a warrant to be issued. That could, but probably won't, trigger a new requirement for bail. I say this because your explanation for why you missed the court date is excellent, and should be all you need to straighten things out. But I don't know which judge you were in front of, and that can make a lot of difference in the outcome of this failure to appear. You should go to court at the absolute soonest time and offer your explanation to the judge (bring all the documentation that you have and the judge will look at it). Better still, ask the attorney who represented you to handle this for you. If you didn't have a lawyer (or a public defender), you might want to have one now, just to make sure that everything goes well, as it should. You can file for divorce on your own. You will need to serve him with a copy of your divorce petition, which might be tricky if you don't know where he is. If you can't serve him, you can still get divorced, but you will be limited as to what you can do with the property.

I know you say you can't afford an attorney, but you don't really know that until you talk to some. You might be able to find someone who will draft all the documents for you, including the deed you'll need and any alternative service pleadings that might be required to get the case going. My office does "limited scope representation" where we just do the paper work and it's a lot less expensive. You end up having the face the judge yourself, but if your paper work is done right, that is not too bad if the case is essentially uncontested due to your husband's absense.

Anyone can sue you for any time for any reason.

Winning, however, is completely different.

He would first have to prove that you owed him that debt. That might be harder than you imagine. He would need something to prove that you were ordered to pay him that credit card debt.

Secondly, I think the statute of limitations has probably run -- I don't have books at home to look it up - sorry. You might go to the UH Law site - Richard Alderman's the People's Lawyer and see if he addresses it. I also think you can "google" statute of limitations & Texas. Or, go to the Harris County Law Library.

Can she "legally" make threats of legal action? Sure. She certainly has the right to disagree with your story, and we only know your side. However, until she has taken the action, there is nothing for you to do (and probably nothing you can do). Stop communicating with her, if you are. If she does take action, you retain a lawyer to represent you. One point to clarify - Contract or not, you cannot take things like customer lists or other such information owned by the company. You also would have potential problems if you were working for them, and being paid by them, and at the same time soliciting their customers for your business. Again, notjing has happened and we know your side only.

Maybe yes. Maybe no. It depends on the exact wording of the deed. You've been negligent in the first step any executor should do before starting probate (getting a lawyer). Get one now. You need one. If you're lucky, the title did pass and the lawyer can do an assent (you do not do a deed) to devise. If not, you need to complete one more probate.

I agree with Attorney Ashman in general but there is a simple way to know if title to the land passed to your father or not. Get a copy of the deed and read it. How was the property titled? Who is listed as grantees?

if the land was owned by your parents as joint tenants with a right of survivorship then the land automatically passed to your father upon the death of your mother (assuming they lived in Georgia and the real property in question is in Georgia). However, if your parents owned the land as tenants in common or as joint tenants (if each had a 50/50 share) but there is no language creating a right of survivorship, then upon the death of your mother, her 1/2 share of the land would not automatically pass to your father. Instead, you would have to review her will to see where her 1/2 of the land went.

You also do not indicate what other assets were owned by your mother if any. An estate may need probated for her depending on what she owned.

I suggest that you take both wills to a probate attorney who practices in the county/state where your parents lived at the time of their respective deaths and pay the lawyer to review the deed and wills and advise you as to whether probate of your mother's will is necessary at this juncture.

Under North Carolina General Statute 20-138.1 there is no such thing as a DUI (Driving Under the Influence) in North Carolina; the standard in North Carolina is "Appreciable Impairment." Appreciable Impairment is a higher legal standard than simply being under the influence. The State must prove Driving While Impaired (DWI).

The theory of Aiding and Abetting is a common law theory which results in the person being guilty of the actual crime if convicted. Thus you should NOT plead guilty to Aiding and Abetting a DWI you you will be sentenced as having been convicted of a DWI. (There is a provision that the sentencing will always be at the lowest level: Level 5)

If convicted on Aiding and Abetting the sentencing is pursuant to level 5 punishment. The details of this punishment are listed at NCLawyer. You do need to hire an attorney for this charge, it is too serious to go unrepresented.

Of course, if it is your typical chapter 7 no asset case, then the most you can hope for is possession of the premises. It depends on how long you have been there and if you have a lease for an extended term that has not expired. If you have a term lease - such as six months or a year, etc., she can't move you out until the end of the term. If you are on a month-to-month and have been there over a year, she must give you 60-days notice; under a year, 30-days is all that is required. Other than that, unless Glendale has a rent and occupancy control ordinance that I don't know about, she has full legal rights to terminate the tenancy to move a relative in, or for any other reason not prohibited by law (such as racial discrimination in housing).

Obviously, the concern has to be what happens if and when the LLC sells or develops the lot needing an easement. Loan agreements and the like must provide for the granting of an easement (or other mutually agreeable access provisions) upon the first cognizable separation of record ownership. Indeed, if agreements between the LLC and a prospective buyer of one lot reference an intention to grant an easement, a court is very likely to hold that such easement comes into existence upon the buyer taking ownership, without an further documents being executed. Finally, I'd be cautious about owning multiple lots in a single entity without first getting good local legal advice regarding the possibility of county authorities deciding to merge the parcels to conform to local lot-size and zoning objectives.

Hmm. First, do not be afraid of punctuation. The comma and the period are your friend. As you speak to different lawyers or counselors, it is important that they can understand what you are writing -- and this was quite difficult. Every third sentence start a new paragraph. Just a suggestion.

As to the matter at hand, it sounds like you are frustrated, but your boyfriend is not. Ma'am -- you cannot prosecute this on behalf of your boyfriend. He has to care. You already know the correct answer to your question. Your boyfriend needs to take the baby-momma to court. He is allowing her to control the situation. A better question for you: why does my boyfriend of over one year allow this other woman to control him? You need a solid answer to that.

Remember this -- in all but exceptionally rare situations, there is ALWAYS a motive. Why does your boyfriend "never know when his next meal will be?" He is okay with that. Hmmm.

Tell your boyfriend to grow a pair and take this matter to court. Have the judge conduct a paternity test on BOTH children and sent the matter for a custody hearing. I don't believe that this intrusion on your privacy rises to Constitutional issues as educators have certain immunities concerning their supervision of students. On the other hand, he clearly invaded your privacy in failing to obtain the consent of you or your parents before "seaching" your phone. This is my opinion only and I have not researched this issue. The primary things you have to think of 1) what are your damages; 2) By suing the school district and or the vice principal (if such a suit is permitted by the courts) are you ready to undergo the effects that such a suit might have on your day to day dealings with other students and teachers? Sending cash in the mail was for lack of a better word - stupid. Sadly, you are most likely right, some complete jerk opened your daughters mail, pocketed the cash and tossed the cards. This would be criminal violations of state and federal law. From a legal standpoint, here's what you are most likely going to be able to do about it - nothing! The reason you aren't going to be able to legally do anything about it is because you have no proof who did it. Unless you can get someone to admit they did it either on tape, in writing or some other media admissible in court - you are probably going to have an extremely difficult time getting law enforcement or postal authorities to be able to help you. However, what you can do is let your daughter know that you and other family members who love her sent her cards and money and that some slimy piece of crap that most likely lives with her stole it from her. Your 15 year old daughter can probably do more damage to the thief than the court could anyway. In the future, send a check or gift cards with a pin # that you can separately and directly communicate to your daughter.

How about a good "lawyer answer"? It depends. If the trust is "funded" (that is, assets are titled in the name of the trust), then the Will won't have an affect on that property. Most trusts come with what is called a "Pourover Will", which will funnel assets into the trust after death, assuming the assets were not in the trust to start. However, if the new Will overrides the old Will, and assets are outside of the trust, those assets outside the trust will pass as the Will directs. If you truly want to override the trust, it should be revoked. However, this area can get complicated, and you could end up with a result you don't want. I suggest taking the time to have an attorney review your entire estate plan, let you know how your plan would work if you died today, and then you can make changes if you don't like the result. The birth certificate does not matter. What matters is whether you have legal determination of paternity. This can happen in three ways: 1. being married to and cohabitating with the mother at conception; 2. mother and father signing a voluntary declaration of paternity form in the hospital, or signing it later and filing it properly; or 3. having a court determination of paternity. If you do not have paternity established by one of those three methods, you have to start by filing a petition to establish paternity. In that proceeding you can obtain temporary orders preventing removal of the child from the state. You will then have to convince the court a) that you are the father (modern cheek swab DNA testing makes this easy to prove or disprove), and that it is in the best interests of the child not to move away. If you already have established legal paternity, then you need to file a proceeding to establish custody orders. In that proceeding you can again obtain a temporary order against the child leaving the state. You then still have to prove that it is not in the best interests of the child to move.

Although you legally have the right to represent yourself in these proceedings, I strongly recommend against it. If the other party does not have an attorney, you may be able to get by with a limited scope representation where an attorney advises you, but does not take over the case for you. If she has an attorney or gets one, you are almost certain to lose unless you hire an attorney to represent you. Usually, there will be a municipal or county ordinance prescribing what the building inspectors may and/or must do, and these ordinances are then subject to court scrutiny under the Fourth Amendment of the U.S, Constitution, which prohibits "unreasonable searches and seizures."

In many instances, the courts, including the U.S. Supreme Court, have approved the searches by building inspectors on the basis that they are reasonably necessary to promote safe buildings and safe uses of buildings. There have been strong dissents. The inspectors and the local ordinances they work under must limit the scope of these inspections to civil rather than criminal matters, for example. My understanding from your description is that the area in question is from your breaker panel on the exterior of your home to the street. The Constitution is only implicated in areas where there is a reasonable expectation of privacy.

Couple of issues here; that you were not yet served with papers does not mean a lawsuit for personal injuries has not been initiated in court. There is a period of time in which a plaintiff may serve papers on a defendant, after filing the originals in court. It may be the judge looked into the court's computer system and found a personal injury case pending against your son for which you have not yet received papers.

As for the DA possibly being mistaken about previous accidents, there is something called sovereign immunity and it generally works to bar lawsuits against assistant DA's acting within the scope of employment. In any case, prior accident involvement would not likely rise to a level of slander, as defined by the law, in these circumstances. You might try checking into the NYS court system's website to see whether the judge was correct about the lawsuit against your son. If so, be sure to alert you son's insurance company right away. You will probably want to check with the real estate commission on that one and review what documents you signed, but likely, the agent has no liability or even an ethical obligation to tell you to get the place inspected before you take it. You probably signed something to the effect that you are accepting the property "as is" and that you had the opportunity to inspect for defects. But again, you'd have to review the documents to be certain.

Even if you intend to accept a property "as is," it is ALWAYS important to have the property inspected prior to making a purchase, and make sure that the sales contract allows you to withdraw from the agreement and get your earnest money back, should the inspection reveal something that changes your mind about making the purchase. Even if you want to still buy the property because (as in the case of a foreclosure, it is a really good deal), it is important to know what problems, if any, already exist, and what could come up in the future so that you can plan accordingly. In addition to a property inspection, a termite inspection should also be conducted.

Also, an inspection should be done by a certified inspector. I have seen numerous buyers discover much too late that their inspector missed something major and ultimately costly.
