They have been married for 28 yrs, she is 20 something yrs younger then him. He is unaware of what is has done and she has durable power of attorney.

The officer that was called over told me, "I'm arresting you, but I'm letting you go", and told me to make sure I appeared in court at the date listed on the ticket she issued me. Then, when I called to try to get a continuance on the court date because of the new job I just started, I was told that there was a warrant out for my arrest in regard to this crime. Is it legal for someone to be arrested twice for the same incident? I was told I can pay $300 and immediately bond out, but I don't understand why the officer said "I'm arresting you, but letting you go" if I was only going to be arrested again for this. It doesn't make sense, and even though I know what I did was wrong, this whole process seems like something's gone awry with it. claim by lawsuit. The amount of damages may not justify a lawsuit but you can

notify that association of the misrepresentation. You also could file a claim in

It's a little difficult to give an opinion without knowing more about your financial situation relative to your income and ongoing living expenses. While alimony isn't out of the question, the fact that you've only been married for 5 years may help you since the court's often don't award alimony in situations where there's a short term marriage. Also, alimony will be analyzed by the court taking into account how the debt is allocated. If your wife will be taking a car that is encumbered by debt, she will get that debt. You will, in all likelihood, be required to assume all of your student loans, unless you can demonstrate that those loans were used to meet family expenses and not just school costs.

At the outset it would be good to talk to an attorney who can help you sort through the process and what bills need to get paid. Generally you will not pay the deceased person's bills EXCEPT through the normal course of probate administration. The law has a certain order of priority for paying bills and most creditors need to be notified and file claims before they should get paid. An exception might be for a house or other asset that runs a risk of repossession / foreclosure.

Since the estate itself cannot go into foreclosure but perhaps you mean the real property your father owned? Generally the lender has the right to start foreclosure proceedings if the mortgage is not paid. Ordinarily the mortgage needs to be paid off when the property changes hands (either by the heirs getting a new mortgage or by sale to a third party) but in some cases a lender will allow the old mortgage to be assigned.

Yes, you can file a wage claim, but not for the full twenty years. There is a statute of limitations in place.

It is clear that you can obtain a claim for up to three years under California Labor Code 226.7. There is a theory that you can file a claim in court for up to four years. To my knowledge, however, no California Supreme Court decision or Court of Appellate decision has upheld that theory, as it applies to claims for missed rest breaks, and allowed monetary recovery for that fourth year.

As you know, some areas have recognized a moritorium on new liquor licenses. You may have to get the previous license reinstated or renewed, or be out of luck. If you made the liquir license a condition of your purchase of the business, you may want to get the seller involved in getting the license back. If you did not make the license a condition of the purchase, then you may have to change the business to a non-liquor endeavor, or appease the chruch/school. There was not sufficeint facts here to see what that might entail.

You are extremely unlikely to find a buyer. No one is going to want to buy into a property they cannot use or occupy except by filing a lawsuit against your brother. And even if someone were interested, they would only pay you a few cents on the dollar for the value of your share. The "forced sale" option is called a Partition action. That is your only option other than to do nothing. The bad news is that an average partition action costs between $10,000 and $15,000, and it is a full-blown lawsuit. The good news is that $10k-$15k is not very expensive as lawsuits go, and the reason the cost is (relatively) low is that the mere filing of the lawsuit, together with the fact that unless the parties settle by agreement the court basically always must order the sheriff to sell the property at auction (like a foreclosure), usually brings the parties to the table for one to buy out the other. In fact I have never heard of a Partition case going to trial and sale rather than settling. The sooner the owners come to their senses that there is no way to avoid a sale except by a buy-out, and the sooner they settle any claims for reimbursement for any money put into the property, the less the case costs. In some cases just the threat of the lawsuit coupled with an offer to mediate the matter gets settlement talks going. I note you used a Sacramento County zip, code, which I assume is the location of the property. I have two facilities in the Sacramento area for handling cases up there. If there has not been a case filed in this state then you could move without asking permission of a court. The father could file a case in this state even if you move for up to 6 months after you move. 6 months after you move you could file a case for custody in the state you move to (although you would need to consult an attorney in that state as the laws are different in each state and this only applies for Kentucky).

If there has been a case filed in this state you would have to ask permission first (in writing to the father) and 60 days prior to any move. You would not have to file anything with the court unless he objects to the move in writing or through the court.

You can file for child support regardless of whether he files for disability or not. If he files and gets disability, your child may be entitled to benefits as a result of his disability if he is granted disability, and even if not, the father will have to pay some child support based on the amount of monthly disability benefits he gets and your income. If he does not file or get disability, he will most likely have to pay child support based on his potential income and your income.

You should get a lawyer. First, they have to prove you had intent to steal. Second, there is a register in the patio area so you could have paid in that area for the juice - the LPO jumped the gun in stopping you.

Last week they distributed a Credit Card Authorization Form, along with a letter stating that the credit card will not be charged unless there is a past due amount. The simple answer is yes they can make signing the authorization a condition of membership. You are free to sign it, or place your business elsewhere. Both of our children take stimulant medication which is a controlled substance and in any case, I do not believe I should be leaving a bag with this type of medication at the curb. Our relationship is extremely contentious. He pulls me in to court as often as he can to request reductions in support or to request the children be court ordered to public school. Most often, he will not speak to me and when he attends a school function involving our children, he acts as if I am not there which puts additional stress on our children. He has been ordered to co-parenting classes but has not yet taken them. He does not respond to emails when I ask him a question. The family court services mediator has recommended that his legal custody for educational decisions be revoked and since that recommendation, he has shown up for school related functions. Our next hearing is in mid December and I wonder if I request a psych eval, if there is any chance that it will be granted?

Got a DWI in 2010, it was my first offense, and I registered a .12 vs. a legal limit of .08 in NC. I hired an attorney, who appeared for me in court, and plead me guilty as part of a plea deal. I lost my license for a year, was placed on probation, did community service, attended addiction classes, and was fined.

While I thought this was harsh for a first offense, I only today learned why. All on my court paperwork shows my blood alcohol level as .17, more than double the legal limit. This means my offense was one with Special Circumstances, which raises it from Level One to Level Five. Apparently, someone at the court copied the poorly formed 2, on the officers ticket, as a 7. Further, nobody, including my attorney, looked at the breath test and saw there was a mistake.

Is there anything I can do now? Obviously, I've already served any punishment, but I'd like to correct the record and make sure my insurance company and vocational board know the truth.

You are a ding dong of the first order The levels go from one being the most sever to five being the lowest not the other way around as you mistakenly believe. Even at a .17 for a first offense this would only be one grossly aggrivating factor - not 'with special circumstances' (where did you even get this stupid term from?). If you had a decent DWI attorney even half worth his salt, he would have found you mitigating factors that would have countered the .17 to put you legitimately into levels 4 or 5 for punishment - again the lowest two levels. At the most, the mistake of .12 versus .17 means you skipped out of the interlock device on your car if you received a limited driving privelige during your suspension. While your pesudo honesty is somewhat admirable, you hardly need to go and make any corrections - especially to bloodsucking insurance companies. If you wanna donate money, donate to some victems of DWI charity not the insurance companies. Better yet, why don't you just concentrate on not ever driving drunk again and putting innocent people on the road at risk. This of course is the primary lesson you should have learned from all of this. If you truely learned that lesson - trust me - every District Attorney and Judge in the state will be satisfied with the punishment you received.

You should do your first attorney the courtesy of contact him/her and advising what you found. Chances are that the mistake did not effect your sentence at all. The only way that it would have effected the outcome was if you had been ordered to put an Interlock into your car for a year (required on ALL cases above a .14).

When I lived at the home there were never any water damages or leaks. When I sold the home I was under assumption that the fixed cracks when I bought the home were waterproofed, and the fix was working. On the discolosure I wrote waterproofed under the foundation/basement section. When I sold the home, through many inspections, estimates, and appraisals it was determined that there was some leaks in the basement that needed to be fixed. I disclosed then to my realtor who disclosed to the buyers agent that the basement was not waterproofed, but there was a remaning warranty on the cracks that were fixed with a rubber material that was waterproof...not the whole basement. The buyers still agreed to purchase the home, with a monetary allowance to fix the leaks in the basement and other repairs with the house. To me this is clearly stated that I was initially wrong about the disclosure but fixed the confusion later. The buyer was fully aware of the leaks after the inspections...and I of course paid to have them fixed per the buyers contractor estimates. I have since received a letter that I am being sued. What should I do? I dont even live in the state anymore! Who is in the right here? What are my options? Do I need an attorney? Please help!

If your domestic partner is of the opposite sex, there is a chance that you could end up meeting the elements of an informal marriage (aka Common Law Marriage), in which case you could create community property in Texas. If a common law marriage were created and recognized by the court, you might be forced to provide insurance even after a break up.

It is worth having a family law attorney look at the actual agreement, however. Advice from a web site like this is limited in value to the extent the responding attorney(s) don't actually see the document you are talking about.

there are no other heirs.

I was advised to do a Disposition of Personal Property W/O Administration

at that time which I did. At that time what was non exempt was money back

from Allstate for 138.09 , Citizen Auto Finance refund for 184.09 for a car he

put in my name before he passed awat and that I paid off (so refund was actually

from my payoff submitted). Bank Account (joint account $78.08). And

a refund from a separate entity for $1697.25.

We filed the paperwork and it was processed through the Clerk of Courts and

closed Dec. 2nd 2005. Just recently we found out there were unclaimed

monies for some very old life shares of stocks. This money would be a god

send as right now things are very tough.

This was located through Florida gov treasure hunt a website listing unclaimed

monies. We completed all the paperwork and submitted everything we are

now being told after review that we need a summary of administration.

However I want to stress I did not submit the order of disposition of property

w/o administration. Can they make me go back a do that as to be honest

I do not have $1200 or $1500 to do that. The amount for these shares

is $5300.00.

Based on the described facts, you may file a summary administration because of the nature and amount of your father's assets. You are advised to contact an attorney to do it properly and represent the matter in probate. If the shares involve unclaimed property in the state of Florida, you will need to be able to prove your right to the property through a summary administration process which is relatively quick and without significant expense. Not certain your meaning of "life shares of stocks," however, it appears that your father did not designate a beneficiary or there would be no need for a summary administration.

Under Kentucky law, a father is presumed to have co-existing and equal custody to a child. So, if the baby is his child and there is no court order assigning custody or timeshare, he could keep the baby until something gets before a court. He would be stupid to do so, but I would not be surprised if the police refused to intervene without court orders.

As for the no-contact order, without knowing the exact provisions of that order or the background to it, I cannot speculate as to how the court would view his contact with the baby.

I you are in a union, you need to check with your collective bargaining agreement. You may or may not have the right to be rehired, and there may be deadlines placed on notices of one or the other, but you will want to check with your union steward or rep and your collective bargaining agreement.

If you are not in a union, you will want to check with your contract for hire. If you do not have a contract or collective bargaining agreement of some kind, it is possible that you could be an at-will employee.

If this isn't a "re-hire" issue but instead is a lay-off issue, there are some federal laws that require prior notice before certain numbers of people are laid off by certain kinds of companies. You should speak with an attorney in your area to see what is available to you after you check your collective bargaining agreement or contract.

If he marries a U.S. citizen he will not be eligible to adjust status in the United States if he entered the U.S. illegally. (However, a waiver of inadmissibility might be available in that instance).

If you do not have the Will, then how do you know who the executor is? If you have no Will, then you can open a probate "intestate." Without any legal action, the assets still belong to the estate of the deceased. If someone took the assets without the legal right to do so, then you have a claim against that person and it may be a criminal theft as well.
