Last Friday, I was involved in an auto accident where I was rear ended by another vehicle. It all happened when I was proceeding through an intersection, where I clearly had the green light, when a young boy on a bicycle darted out in front of me in the crosswalk. When the child came off the curb I was about halfway into the intersection and was able to avoid not hitting him. However, as I waited for the child to cross on his bicycle for a few seconds, a car rear ended me in the intersection. After the accident, I pulled aside and got the drivers information only to find that she could not provide me with any insurance information. Fortunately, I have noninsured motorist coverage on my policy and have started a claim with my insurance company. My question is, is the father of the child on the bike responsible for any part of the accident since he was waiting at the crosswalk?

I try to avoid not hitting the rugrats, myself. Usually in "dart-out" accidents (where the kid gets hit) the juries are sympathetic to the motorist. If your damages are significant sure, you could go after Dad. If nobody was hurt it's probably a small claims court case.

Your question is about employment law, not constitutional law. Please re-post it under that heading.

I'm no expert on employment law, even here in California. But in general, an employer is allowed to do what you describe unless doing so would breach an existing contract with the employee. That could mean an individual contract, a collective-bargaining agreement, or a combination of the two. In some states, the contract could be either oral or written. And in at least some states, the written contract need not be in the form of a formal, signed agreement. (For example, an employee handbook might be part of such a contract. So might emails between the employee and his superiors.)

Even if the employer has the right to make you sign this type of agreement, the particular agreement they want you to sign might be improper.

My point is that your question is not simple, and that the answer might vary quite a bit from one state to another. You will be more likely to get answers from lawyers who have the relevant expertise if you re-post it under Montana employment law. And if you can, you should meet with such a lawyer and go over the proposed agreement with her.

I have filed a suit in small claims court for rent owed and damages to property for 5,000.00. I have just received a certified letter from the tennants requesting names and addresses of witnesses I plan on using at court and all documents and things I will use at trial. They have requested that I foward all of this information to their present address. Am I required to foward all that they have asked for?

If you only received a letter without referrance to the court pleadings ( case name and case number) and not an official court pleading requesting this information, the answer is no, but I would need to see the paper work to be sure. However, what is the harm in providing the information? You will need it for the hearing anyway and may make them settle up with you if they see the evidence. Why make this an issue for the court at the final hearing? Think about the effect on your case if you loose the argument.

The maximum fine under state law is $500 plus costs and surcharges. No one here can predict the fine or outcome, but in many courts, with a lawyer and a pretrial, a prosecutor certainly might entertain a plea bargain based on the facts (which we don't have) and your driving history.

I was in an auto accident 7/23/12. I dropped my vehicle off to a repair shop in Fl for an estimate. Since I wasnt the person at fault, another insurance company was responsible for the repairs. A few days later I contacted the shop to see if the adjuster arrived. The shop said they were finished with the repairs and they wanted their money. I didn't authorize the repairs from that shop. My Father is a mechanic and he told me to send my car to a dealership for the repairs to make sure the work is done, but it was too late. My car has been there almost two months. I was injured in the accident and I couldn't work, so I ended up spending the insurance check on other bills. What can I do? I'm without a vehicle and I'm unemployed.

If you did not sign an authorization for repair then the shop should not have performed any work. Florida also requires that they provide you with a copy of the estimate and inform you if the estimate exceeds the original by more than 10%. However if you spent the insurance money meant to repair the car then there is a good chance the shop will apply for the title to the car. A shop exercising a lien for repairs can take a vehicle free and clear of any loan against it. If you have a lawyer for the injury you received in the accident you should discuss this matter with them.

They asked me for my records which I provided and my Boss proceeded to interview me and get very close to my personal space he made me feel really uncomfortable and started questioning everything I recorded, which I started answering but he was combative. He then stated I was insubordinate and I then sensing it was going somewhere that I didn't want this to go I got up and said I'm not taking this and walked out. The HR Rep followed me out and told me to take a day to calm down and I did. I have been working for this company for almost 4 yrs I work in the Loss Prevention Department which is why this was so uncomfortable I handle High Profile Investigations and cover the entire North East and Mid West. I have received awards and have been put in Leader ship development programs offered by the company which was 2 weeks ago. I never received anything less than Exceeds on all my reviews and I have brought the company millions of dollars in restitution which I was recognized for with several awards. I don't understand what happened and why but to be put in a situation like that which I have never been in was disturbing. I don't know what rights I have if any or how I should take this further. I did request a meeting with the HR Rep to speak with but at this point I can't work for this guy so what are my options, quit, let them terminate me?? If they do on what basis? and do I really have any recourse?

Not as good as if you hired a lawyer. Unrepresented parties are easy pickings for insurance adjusters. You don't know your rights or their responsibilities, nor do you know what your case is even worth. I've read that people that don't hire lawyers for accidents get less than 1/4 of what represented parties get on average. That sounds about rigtht from my experience. Most unrepresented parties end up screwing their case up so bad they get less than $1,000, from what I have seen. Still, it is your unconditional right to represent yourself. Good luck with it.

the drive and fan belt are known to give in after a certain times which is why the have to be changed every so often.
But they should've taught about this in your driving school as this is a requirement of basic motoring knowledge (where I live it is anyways) alternatively if your fan belt snaps on the road. keep a nylon sock handy as you might be able to replace the broken fan belt with the nylon sock until you get to the next garage to have it repaired.

I agree with Mr. Schneider. I would suggest you apply for a U.S. Passport for your child and that you hold it. I would also ask the court to order the passport be kept in your possession and to ensure that your ex does not apply for a lebanese passport I would also request the court order him not to apply for such a passport. I was never notified of this by the Debt collection attorney (I just spoke with them last Thursday) or anyone else for that matter. First of all, how do you know for a fact that the hearing was postponed? If it was postponed, then the court is not going to hear the case and it certainly will not be thrown out.

As to whether they have to notify you, maybe they have and you have not gotten notice of it. I don't know what county the action is in, so I would check the local rules. Nothing in the state civil procedure rules address whether you have to be given notice.

If you will be out of the country and want to attend, then file a motion for continuance to postpone the hearing yet again.

However, what is going to happen if you show up at any hearing? What exactly are you going to say? If this is your debt, they will recover a judgment against you regardless of whether you show uo or not.

Before you do all this, what exactly do you hope to accomplish? Is this your debt or not? If you have a defense to the charges, then get local counsel to protect your rights. If this is your debt and you have no defenses, then spending money on a lawyer to litigate is not the most productive use of your funds.

I'm sorry to hear about your story. The one good piece of news and all this is that you actually are required to keep her on your insurance until the divorce is final. Also, by law, you are required to wait six months from the date of filing at a minimum to finalize the divorce. There is no real outer limit on how long you can wait between filing and when you finalize the divorce. So there is no problem of any kind with keeping hurry on your insurance until the child is born, and in fact nearly indefinitely as long as you don't finalize the divorce.

Here are some suggestions --

You can go to the courthouse and ask for the last court order regarding this child. You can also ask to see the file. You cannot remove any papers from the file but you can look at it and try to figure out what has occurred in court.

To get a copy of a court document costs approximately $1 per page so take cash or a credit card with you. Most courthouses will not accept personal checks.

If a parental termination has occurred, the file might be sealed. If so, you cannot get a copy of any document in the "sealed" file. But if the clerk at the courthouse tell you the file is "sealed" then you can assume that the worst has happened.

If your parental rights were terminated, then you have no rights to this child. The old court order listing you as a joint conservator has been over-ridden by a new court order.

It appears that the child is a teen-ager. When the child reaches the age of 18, you can contact the child directly. Also, the child can contact you. In Texas, at 18 a person becomes an adult with all the rights of an adult. They can do whatever they want.

In terms of inheritance, when a person dies in Georgia without a will, and barring the filing of a year's support by the spouse (see below) the property of the estate should be distributed "per stirpes", which means to his spouse and child equally, with the caveat that the spouse receives no less than one-third. This formula means that a spouse, so long as she does not own 1/2 of the house already via deed or joint ownership, would always have less of a share than the children when there is more than one child. However, she would still be at least a 1/3 owner of the home, so she could not just be evicted. If she refuses to leave or sell, an action to partition and sell the property may be the only way to get her out. These situations can get very ugly, and often do when the spouse is not the mother.

However, a spouse (for themselves or their minor children) may file an action for year's support, stating that she needs all of the property in order to live, and can use that to cut out the adult children of the person who dies. Year's support petitions are very hard for children to overcome, resulting in the spouse getting everything, including the house, and the children getting nothing.

I agree with Attorney Gardner. I only point out that based on your facts you do not indicate how the man owned the land. If he owned jointly with the wife as a joint tenancy with right of survivorship. If so, then the home would pass to the wife outside of probate.

As noted, if the man owned the land solely, then the wife has a 1/2 to 1/3rd share of the estate (depending on how many children the man had - if he has 1 child, the child and wife split the estate; if there are 2 or more children then the wife gets 1/3 of the assets).

Of course, this assumes the man had probate assets. Not all assets are probate assets. Examples of things that pass outside of probate are land owned with a right of survivorship, joint bank accounts or beneficiary-designated assets like life insurance or a pension. If the wife was named as a beneficiary or had a joint checking account, then she may well end up with most nearly everything after the spousal yearly allowance and family exemption are considered.

In law school they taught a mnemonic of what was needed to make out a claim of adverse possession. It was OCEAN and it stood for Open Continuous Exclusive Adverse and Notorious. It is very difficult to make such a claim in Pennsylvania. The reason is that the land has to be held for 21 years and meet those conditions. So, unless your neighbor was cutting the grass on the side of your house for 21 years without your permission and was claiming it was his property and excluding you from using the property by fencing it in or posting a sign, you shouldn't worry about it. But you should start cutting the grass on that side of your house yourself.

If you'd like to design the mechanical aspects of automobiles, you'll want to get a degree in mechanical engineering. This will give you the toolbox and basis for car part design. For example, when designing a turbo system for the engine, you'll want to figure out what type of ball bearings to use, or how the heat generated will affect the surrounding systems. In school, you'll have learned about force diagrams and heat transfer between materials. Same goes with designing the shape of the car. The Prius' shape minimizes the friction/drag from the air it drives through. An engineer had to figure out what shape was optimal for a low co-efficient of friction when driving.

Of course, the shape of a car and how a car looks and feels, is also up to the marketting team. Graphic design or product design is more applicable to how a car looks, where the schooling is more about connecting with the customer and ergonomics (less about hardcore engineering and numbers).

Computer engineering and Electrical engineering are also important roles in car engineering, but deal with other aspects of the car that are more specific. I think if you are looking for an overall education to get into designing cars, mechanical engineering is the way to go.

Different types of evidence have different rules to present evidence properly. Further, you also have to know how to overcome objections to your presenting your evidence. Finally, you have to fully understand the rules of evidence in order to properly object to evidence presented by the prosecutor. Remember, the Judge cannot help you and will allow the prosecutor's evidence to come in, even if the prosecutor is not complying with the rules of evidence, unless the prosecutor is way off the permissible extent of the rules of evidence.

You will be at a severe disadvantage if you go to trial against a well trained prosecutor who is a lawyer and has years of both legal training and actual trial experience.

Hire a criminal defense attorney and come to terms you have to pay form those services.

You have something that you believe is discoverable, and want to comply with the DA request. How do you do that? If that sums up your answer, I would first tell you that most, if not all of your evidence is not discoverable. You should get counsel before deciding that something MUST be given to the DA. Second, if you must present discovery to the DA, you need only do the same thing they did. That is, they can have the discovery if they ARRIVE at any location you specify; on the day and at the time you specify, and pay whatever nominal copying cost you speciy. You can also specify payment method "I don't take checks and I don't accept cash. Money Order only. It must be payable to "I am innocent, Inc". The DA will likely not bother to get the evidence from you. If I guessed your question, that is an answer.

If he believes he did not get what he paid for, he can go up the chain at CVS (to the store manager than corporate Customer Service), or file a small claims suit (likely not close to worth the time, money and effort). Keep in mind two things. One, pharmacies, generally keep very good records of every pill. If there are 40 missing, they will know. That does not mean they did not make a mistake here, but these mistakes are relatively infrequent and usually caught afterward. Second, Addrerall is one of the most abused drugs out there, has a huge black market and the pills are often sold by the person who has the prescription for a very nice profit. It is especially popular with younger people, including high school and college students. Before you go too far, you better be sure it really was the pharmacy at fault. Otherwise, criminal law might be the correct category because someone could be going to jail for selling their pills. No one here knows you or your son, but it would not be the first time the same story led to an unanticipated result.

You told us that this was your ex husband. If your ex husband died without a will or trust, then the laws of intestate succession state that his surviving spouse has inheritance rights. Because your marriage was terminated by divorce, you are not his surviving spouse. (See Probate Code section 78.)

In order for you to inherit anything at all, you would have to have been specifically provided for in a new will executed after your divorce, or a new trust established after the divorce. I doubt that happened.

I would like to construct a privacy fence on my residential property line. I have had a property line survey completed and stakes have been placed marking the property line. Can I build the fence directly on the property line or should I have it built back a few feet? I am concerned that if I have it built back a few feet that I will lose my property ownership on the other side of the fence and I will be unable to maintain the shrubbery on the other side.

Unless there are porperty associaition covenants against building fences on the prorepty line, you should be able to build your fence on the surveyed line

I have full physical and joint legal custody of my 2 boys. They were removed from my now ex wife due to endangerment and neglect by dcfs last may. My ex was ordered to complete domestic violence classes along with a few others and do random drug testing and failed to do so and has still not even made an attempt. She got monitered visits and during the whole court process she was having visits through the social workers office. Recently my new wife and the boys and I moved an hour away from my ex and we recently had a daughter. I support my family of 5 on my own with no help whatsoever from my ex. In the past 3 months she has come for her hour visit once! And until yesterday it had been 12 days since she had called to talk to the boys. The visits are held at the park near our apartment due to the fact she has previously repeatedly threatened my wife while she was pregnant and continues to make threats and attempt to break up our marriage. So we made the monitered visits at a public park. She is now demanding our home address and saying its the law. She is also demanding I bring the boys to her for the visits. I'd like to know my place on these issues

I attended an open house with friends. These friends used the same agent that was showing the open house. When I asked the agent why the seller was moving, the agent said ''He'll tell you'', motioning to one of my friends. A few minutes later, not in the presence of the agent, the friend told me that (according to the agent) the seller was moving to a smaller residence to force out the son who is a drug user. The friend also said the the son is stealing from the seller.

I had a concern that if I did buy, there's the possibility that somone would come looking for money owed or that one of the son's friends would stop by.

The next week I went to see some listings with this agent. I asked what was up with the son's drug use. The agent categorically denied any issues about drug use.

I know the agent is working for the seller. But if a real estate agent knows of any personal problems related to the seller, can he/she disclose this information?? If so, when in the buying process can this information be disclosed.

If the seller's motivation for moving is not simply downsizing, does the buyer have a right to know this??

Does a buyer have to be told anything about the seller's motivation for selling??

Hi:

A seller or a sellers agent can not be forced to tell you why the seller is moving.

If you like the house and have this concern, why not take a discrete neighborhood tour knock on a few doors and mention that you are interested in purchasing the home, and ask how they like living in the neighborhood, etc.

You do not have any legal right to force seller or seller's agent to tell you about seller's life. Information about the house and neighborhood will be important for you to know,so the other attorney's suggestion of walking around the neighborhood and talking to people is a good idea.

Three day notice to conform to the lease or move. If he smokes after the three days you can file an unlawful detainer immediately.

First try talking to him and see if you can get him to stop. I am sure that he will not, but it is always best to do so. Then make sure the other roommates sign declarations about his smoking and drugs use before he is served with the three day notice, and then get them to sign amended declarations that he continued through the three day period, as you have no direct knowledge unless you can smell the odors directly and you do not want to go to court without evidence. Point out to him the disadvantages of getting a judgment against him in order to try to get him to leave. You might even want to give him a small bribe after he leaves to save the costs of going for an unlawful detainer [he will likely stop paying rent once served].
