Recently when did refinance and bank reqested condo documents, it was found that the property brought is a condo, the builder filed a master deed in county which only contained two units, after these two units were sold, no HOA was set up and no master insurance from 2004. Question is how to terminate the master deed so each unit can cover their property by themself.

You should have been advised at some point that the property was a condominium. It is not the title company's or the bank's responsibility to tell you to have your own lawyer represent you, and neither the title company nor the bank would be looking out for only your interests.

If the condo is in one building, even if they are separate dwellings, it is impossible to divide the responsibility or ownership except by a condominium regime. If you intend to keep ownership of both units and treat one or both units as rentals, provided that use is permitted in your township and you fulfill requirements for renting out a property, you could still retain ownership and terminate the condominium.

If the property consists of 2 separate dwellings each with its own plumbing and utility lines and other components necessary for a home, and if there are only 2 units, the owners of those units could terminate the condominium.

Termination requires the recording of appropriate documents.

Each owner would still be responsible for insurance and all other property expenses on that owner's unit.

You may have recourse...you need to speak to a real property attorney in your area. The problem is that every deed has a "metes and bounds" descripton of the property. You were on "record" notice of the actual bounds of the property and could have hired a surveyor to confirm the property lines. You need to consult an attorney versed in real property law.

Hello: I agree with both answers provided. To be more soecific, I would need to read the contract you have with the store. You should read it well. Look specifically for any provisions regarding returns. See if their contract for sale spefically states no cash back, only store credit. I have not researched Fla. Law on this, but I do not believe that is absolute. I know if the company has breached the contract, that provision would be void. And if you sued the comp and got a judgment in your favor, you would collect money.

I was married at the time of his conception, and while the question of paternity was brought up between this man and myself, due to the circumstances (me married to his friend) it was left alone. My child was born, accepted as my then husband's child. The child was and is the image of the other man. There has been no dna test, never a need for one as no claims from the other man had risen. I have divorced and remarried and my child has grown up knowing 1 Father. Recently, the bio Dad (yes, I believe this) contacted me through social media. If you are going to get 'legal' advice from random friends, you have no chance of accomplishing anything. Go consult with an attorney in your area who is experienced in lender liability and foreclosure law, to see if the lender has any risk or liability in this.. In general, as long as the lender followed the rules of foreclosure notices and procedures, the lender actions in discussing loan mods or short sales do not delay or prevent foreclosure, unless you got specific written commitment from the lender guaranteeing you delay or something. There are literally millions of foreclosures in the last few years, and until proven otherwise you can assume they were properly handled. That is a normal process for lenders.

Foreclosures are frequently not held up pending negotiations for loan modifications or short sales. They move down separate tracks, handled by separate departments that don't seem to communicate. Now,as to your suit. You didn't say what you alleged in the suit, although I assume you sued Wells Fargo. Did you just ask for money damages, or did you also ask for an injunction and/or get a temporary restraining order? Has the defendant served you with its answer? If you got a TRO, did the defendant comply? In sum, I don't think that randomly filing and serving a lawsuit will stop a foreclosure, nor an eviction following foreclosure. It would have also been necessary to obtain a TRO and, along with that, post an undertaking (bond) to make the bank whole in the event you ended up losing the suit.

When you say written off, do you just mean "charge off" or do you mean issuing you a 1099? The answer is the same. Of course, if they have issued you a 1099c and you later pay all or part of the debt it, you may have to amend your taxes to take into account the amount that you paid and reduce the written off portion.

Has it been 3 or more years (assuming the debt was created in North Carolina) since you last paid? If so, then the original creditor or anyone they sell it to is not likely to sue you. There were some changes to the law in NC. It is now declared an unfair practice for a debt buyer to bring an action after the statute of limitations expires.

You would make and sign the same Will as anybody else. Your Will determines who will inherit your estate, property and money, after the payment of your expenses, claims and taxes. In a Will, you can provide who gets what and when.

I strongly recommend that you make durable powers of attorney, both for health care and for financial purposes. This way, your partner or any other person that you trust, can step in and take care of your personally and financially, should you need or want them to do so. Under the health care power, your agent would have the powers enumerated under a living will, but would have the authority to apply discretion, as you have instructed your agent to do.

These powers of attorney are more important than a Will, because they protect you during your life time.

Shouldn't you make a motion to change the possession of the 16 year old. But if your husband has joint custody, there is a mediation provision in his judgment. He has to ask to mediate the issue of possession of the child and the payment of support. He should do that in writing with a time limit for her to respond. If and when she does not, then a motion to modify the residential placement of the boy and a modification of the support should be filed. Then the issue of what, if anything, he should be paying will be dealt with.

A month-to-month tenant, or his/her landlord, needs to give 30 days' notice of termination to the other under Civil Code section 1946, except that the rental agreement can reduce the notice period down to seven days (which in my opinion would be very unusual). Orange County MIGHT have a different requirement under some local rent-control ordinance, and you should inquire locally about that. By the way, a 30-day notice can be given at any time during the month and the last day of a rental does not have to fall on the same day of the month as the rental began or that the rent is due.

I need more information to answer your question in detail. However, let me say that there are many people who proceed with divorce proceedings without attorneys. I do not recommend that you proceed without an attorney, but that does not mean you do not have this option.

Have you approached this issue with the mediator? If not, you should. Furthermore, if the divorce was filed, then you can file a motion to address this issue in court and with the family relations department of the superior court.

Another option, which is becoming more popular in CT and other states is a co-parenting counselor. This person assists the parties in learning how to co-parent their children. This has become a wonderful alternative to litigating issues relating to co-parenting because instead of a judge deciding something that should be worked out by the parents, the parents are given time to hopefully come to a resolution with assistance.

The government has enough role in people's personal lives, so why not try private intervention?

I have a question with regards to collection agencies, their rights and how they are to handle their affairs correctly.

Lately, for the past 2 months, I have been getting calls from a "supposively" local collection agency, trying to collection on a cash advance debt that I apparently have from late 2007 or early 2008, not quite sure. In the initial phone message I received from them, which I called back since I had no idea what they were calling about, they stated I had a cash advance at some point during that time frame that I hadn't paid back. I am honestly not quite certain of this cash advance, since it has been a very long time since I have needed one, thankfully, so I requested proof from them of this debt, so I can be certain this is a valid debt and not a scam to try and have money taken from me. The representative refused to send me any valid proof of the debt and advised that all he has is my name, account information, employment information, contact information and the amount of the debt and only needs to make an offer to settle the debt, before it is taken into litigation (the amount is not even 500 bucks). I again asked several times for proof and I was denied proof of this debt. I expressed to the representative my concern of the phone call, when in all these years I have never received any demands of any debt pending and I have been living in the same residence since early summer of 2007. The representative continued to try and pressure me into getting into a payment plan, but I continued to insist on having some information sent to me, before I agree to a payment plan. The representative placed me on hold and them just hung up the phone on me and never tried to reach me back. A month later, which is now, I just received a voicemail message from the same company, different representative advising me to call to resolve the issue because there is a pending summons to be issued on me. I still have not contacted him back because before I do so, I would like to have more information on my defenses with this matter, since at no point I have received any correspondence in the mail for years and have been refused copies of documentation for this debt. If you can please provide me with some guidance or direction to better handle this situation, I would greatly appreciate it.

We communicated via email and he was very happy to move back in. He was going to break his lease and move in so he would not have to work so many hours. But my eldest daughter who was living close to him, she one day came over to his house with her baby and she advised him not too. My youngest told me. Then the eldest continued to rob me and my husband. First, she tried to declare me incompetent and that I have dementia. Then she change the beneficiaries of two of his life insu policies about two months before he died==total value $550,000. Then she had someone in husband's law office write a fake will and pretend like my husband had signed it while on life support. And then she marches into probate court and tells the judge I cannot take care of myself and gets awarded guardianship of my minor child. How can I get rid or diminish the power of this eldest child. She is an awful person and is poisong my minor against me It is so sad. What can I do? I must be able to do something and do it now.

Since then the sellers are stating they will not move until the end of June( not stated in anything we signed and they did not tell us until after our offer was accepted). We have paid for an inspection, appraisal, closed out of retirement funds at a big loss to pay for the down payment of April 7th. The sellers will not sign the p&s until we agree to a closing date of June 30th. We keep filing extensions on the offer to "keep the deal alive". They have filed nothing.

QUESTION. If we do not file another (5th) extension and the deal "dies" are we able to sue them for appraisal, inspection, other fees? We continue to file extensions in the hope that they will "work with us a bit". We have even said we will extend the closing until the end of April.

There may be two avenues for challenging the transfer of the funds by your father to your mother: lack of capacity and undue influence. If your mother was handling your father's finances, under recent changes in the law the burden would shift to her to prove that the transaction was NOT the product of undue influence. Since she was of course his wife, she would argue that this is what her dad wanted. However, it appears that she had another agenda, and you could certainly bring this out. The important questions are whether the trust has been already liquidated and if so, whether your mother has any assets that can be secured pending any judgment you might obtain. My ex-husband wants to modify the child support once again because he is now making less money with his new employer. He had his attorney come up with the amount of child support based on his current salary and he went ahead and sent me next month's check with the new amount, without us coming to an agreement.

He just emailed me the documents today with the numbers and I happen to receive the check with the new amount the same day. I haven't even had a chance to review the documents. We have done everything through the courts and I want to know if this is legal for him to just send me a check for the new amount without me agreeing to anything?

It would appear that his attorney is trying to get you to agree and consent to the new amount. I suggest you hire an attorney and go to court on this issue. If not, there will be no do overs. Normally if someone takes a job making less then the court will not accept that unless it is due to injury and disability.

This type of modification should most certainly be done through the courts. Until further Order of the court, he is expected to continue paying the amount previously ordered.

I also find it hard to believe that an attorney would approach this issue in this way, as they must know that this is not the best way to get that done.

I am only licensed in Arizona, so you should also pose your question to a Nevada attorney if you haven't already done so. In Arizona, if you have no prior convictions, you would likely be given a diversion and treatment program for your first possession charge, as long as it is possession for personal use (not sale). Possession of marijuana is a class 6 felony (the lowest class), and can be dropped down to a misdemeanor depending on circumstances. Also, under Arizona's current sentencing laws, you could not be eligible for a prison sentence until a 3rd conviction for personal possession, with some exceptions. Finally, in AZ, "personal possession" encompases up to 2 pounds of marijuana, as long as it is not possessed for sale. I hope that helps you understand Arizona law on the issue, but I cannot answer for Nevada, or as to where you may fare better. She was insisting that I put her name on the deed due to her contributions and lawguru essentially said (all 4 lawyers agreed) it would be a huge mistake to do that for many reasons - not the least of which is the fact that her daughter is on her car insurance and has had 2 major car accidents in less than a year. First, no attorney can force you to give her 45% of any profits on the home.

He can sue for the $10,000 she put in the home and might win depending upon what the $10K represents.

If she gets an attorney you should hire an attorney.

You can enter into a side agreement that says she will get 45% of any profits from the sale of the home, but you need to define profits. You also need to decide what happens if you break-up and there is no profit in the house.

I assume she and her daughter live in the home with you. If she does not pay rent or part of the cost of the mortgage or taxes, what contribution to the home does she make?

In the end it is your decision as to what you want to do.
