The complainant was not on scene that the traffic stop. I have a video/audio of the entire event. There is absolutley no merit to his complaint. This is my 8th internal affairs investigation for similar baseless complaints in the last two years and we are all tired of having to defend ourselves so we can do our jobs.

It certainly sounds like a case of fraud and probably a breach of the Tennessee consumer protection act to me. I'd need to know more about what the exact representations were regarding what a "program car" was intended to be under those circumstances. In Ohio, when you first co-sign for the loan, you and the debtor are both responsible to the creditor to pay the entire loan back. If the debtor defaults, then the creditor will sue you and the debtor, and will likely get a judgment against both of you unless there is a defense to the loan. You will have a cross claim against the debtor who defaulted, and you will likely will likely win on that claim.

But there is an old saying that getting a judgment is easy, collecting on it is hard. That is why people loaning out money want solvent cosigners.

from what you have stated it appears that they charged you with a criminal offense for allegedly giving a false name, specifically obstructing the function of a law enforcement officer in preforming his duties, the charge could be a 4th degree offense if you were attempting to prevent the officer from investigating a possible commission of a crime or any crime which means that the charge would be sent up to the County Prosecutors office for review, however if all you are charged with is allegedly providing a false name to avoid to a traffic summons it would be a disorderly persons offense and it would remain in the Municipal Court within the town where you were stopped. a 4th degree offense could carry up to 18 months in jail besides fines and other penalties, if you have no criminal record you would probably qualify for P T I which is a diversionary program that would allow you to potentially get the charge dismissed. It sounds like you have been issued a disorderly persons offense which also carries fines, potential jail time and/or probation. bear in mind this doesn't mean you need to plead guilty to it, you may have a defense. Initially you would obviously want to probably consult a lawyer because it is a criminal charge. I would happy to speak to you about it if you like. I never charge a fee for a consultation. On the other hand, it's possible that it goes unnoticed all together. The court may also have a practice of only looking for same or similar offenses. Our question is not about what happens in case of default. Rather our concern is if by taking a contract, we are more liable in the event that the buyers have second thoughts, or find something wrong with the house, and stop payment. Are we more liable by taking the contract ourselves, as opposed to the buyer getting conventional financing on a first and taking us a second?

The interest income is welcomed, but we worry about additional risk of not being at arms length with the buyer. These seem to be high end, qualified buyers. He is the head of the planning commission of a large CA city. Thanks

First of all, I suggest you never sell your property with the balance to be paid by a promissory note that is unsecured. You do not mention security at all, and state that you do not care what happens in case of default, but if you are unsecured and they default, you will be forced to have to file a lawsuit, and they can subsequently sell the house while that lawsuit is pending and disappear. Only a fool would loan money on real property without security.

Second of all, if you do carry the balance of the purchase price secured by a deed of trust, you should be aware that the arrangement will fall within the ambit of the purchase money anti-deficiency protection of Code of Civil Procedure section 580b. This means that in the event of default and foreclosure, you will be limited to the property and whatever it sells for then, regardless of the manner of foreclosure that you choose. In other words, you will bear the risk of loss if the market value plummets, not the buyer.

There is nothing in the fact of seller carry back financing that makes you more liable that would distinguish it from third party financing. Your liabilities, and your duty to disclose are the same.

I disagree in part with Mr. Roach. He is correct that you do not have any more or less liability regarding the sale of the property by carrying-back the purchase money loan. You do, however, create a whole other set of legal rights and obligations as a lender that could potentially lead to liability if not handled correctly. It also creates a more complicated tax situation on your capital gains and the interest payment - not better or worse, just a layer of complexity to be dealt with. 6% is an attractive return in the current investment environment, and relatively low risk if you properly secure the debt. For that reason, combined with the stratospheric commissions on the high property values in the Bay Area, I am seeing a lot more of these private sales. In fact I have three I am handling in my San Jose office right now, and completed two others in the last three months. And, yes, that is a polite way of saying that this is not something to do without a lawyer, when you are doing it without a real estate agent and loan broker. It will still cost FAR less than the commissions to those professionals, which would mostly not be earned when you have brokered the transaction yourself, and will be money well spent given the consequences of a botched transaction.

An estate has been settled and it is time for disbursement of the proceeds. The attorney handling the estate as asked that I sign a receipt of the check with my portion of the estate PRIOR to me receiving the check. He will then send me the check. This does not seem right for me to sign I have received a check when I have not yet received it. He refuses to send the check because in the past not every one returns the signed receipt paperwork. I don't live in Washington and the estate is in Missouri. Can you advise on how I should proceed?

It sounds counter to what one would expect an attorney try advise someone to do. But, in Missouri probate practice for an heir to sign a receipt, than get the check. The reciept sort acts an acknowledgment of the amount you are to receive. The alternative is for you to travel to the attorney's office to get the check and sign the receipt simultaneously.

Statutorily you must give "reasonable notice" (in writing) and file a copy with the court. Reasonable is at least 30 days; 60 is better. Also, check your judgment of dissolution for a stated notice period. In the meantime, I strongly suggest that you start discussing this move with your ex with the goal of coming to some agreement on what parenting time/custody would work best for the child. If you can't agree then you will need a hearing and subsequent order. Your ex will want to file a motion for modification of custody and/or parenting time. (She will also probably ask the court for a status quo order to prevent you from moving with the children until the motion is litigated.) Alternatively, you could file the motion even if she does not want to. The point is that it is best to get a court ordered change of whatever is needed because it is probably going to be impossible to follow the existing parenting plan after you move. If you are somehow not complying with the existing parenting plan you could be held in contempt (try not to go there). Try to be as proactive as possible to get a new court order, by agreement or by hearing, so that you are not battling this out at the last minute when you need to be relocating and starting a new job.

What you own is called a remainder interest. Your aunt owns a life estate in your half interest for as long as she is alive. Upon her death, you will own your father's undivided half interest in the house, and , your cousins will inherit the other half. You can have the deed changed if you wish to reflect your one-half interest. It would probably be better to wait.

I want to speak with the lawyer who is handling these things. My father (also named excutor of will) told me he (lawyer) will not speak with me because he reps my dad. Is this true? The lawyer for the estate is supposed to represent the estate but in reality he represents the executor who hired him. Most lawyers will not discuss the estate with the beneficiaries, advising them to tak to the executor.

Since there obviously is something going on between you and your father, you will need to get your own probate attorney to intercede for you.

However, IRAs and life insurance proceeds are non-probate assets. They pass outside of probate to the named beneficiary. If you know that you are the named beneficiary and the identity of the administrator of the IRA or insurer, nothing stops you fom contacting them directly.

The problem will be if your grandmother designated her estate or a trust as the beneficiary. In that case, the proceeds will be paid to her estate or trust and then parceled out.

Also, with IRAs, usually taxes have not been deducted for them if they are regular, not Roth, IRAs. You will need to speal to a CPA about rolling the IRA into your own and stretching it out. You don't want to pay all the taxes in most cases at one time, but it depends on how much we are talking about.

I was walking through a public park with my cellphone browsing twitter and a creepy man was following me like he wanted something. He kept changing direction to go where I was going. I went into some trees to avoid him and he walked straight through a bush and just stopped and stared so I asked him "what's up?" "Why you following me?" He just looke at me and at the same time a security officer showed up and told us we were verbally trespassed because he knew what was going on and that we were meeting for sex (which explains why the man followed me) and told us if we came back he'd call the cops. I did nothing of the sort! Now would I!! But I walked to my car and he followed me in his truck to make sure I left. No incident report. Didn't ask for our names. Just told us we were verbally trespassed and followed me to my car. Will that be reported to the police? If he wrote my tag number down, would he wrote that the owner of that car was there doing what he claims I did BUT DID NOT?

I go there when I'm sad and thinking about the child my girlfriend aborted. It's peaceful with trees, a waterfall, a pond, and ducks to feed. As far as the suit against your husband, it's important to understand that there is a distinction between liability - the responsibility for your injuries, and the ability to collect on a judgment.

As far as the claim for personal injuries against your husband, the party you would really be pursuing would be the premises liability carrier for the property, though you would sue your husband - or ex husband, and the insurer would need to defend him.

From your facts, it does not sound like your husband INTENDED to hurt you - in fact, it sounds like he was intending to prevent you from hurting this other woman (an impulse I think is almost universally understandable).

As such, the negligence, or liability features of the policy should apply, if your husband is covered by the policy. (Insurance, for probably obvious reasons, does not cover intentional acts.)

Whether or not you divorce your husband, you may be able to pursue him, and thereby make a claim against the insurance policy covering the property. ...of course, the insurance company will only be responsible up to the limits of liability on that policy.

While you may choose to divorce your husband as a result of these injuries, and the upsetting events giving rise to them - I would encourage you NOT to use the same attorney for both the divorce, and the personal injury issues. Most personal injury attorneys (myself included) will work for a portion of any recovery, while divorce attorneys are ethically prohibited from doing this, and need to be paid hourly.

I would start by contacting the local health department and see if they will issue a citation to the Landlord for the noise. They will have to come to the building. You can file a complaint against your landlord for nuisance for the noise created by the tenant on the third floor and seek to escrow your rent. You can seek a reduction in your rent in court or credit until the Landlord provides proper sound insulation between the floors.

From my experience, the Landlord will become less than thrilled with you and will become somewhat difficult to work. If the stress is a problem now if you make your landlord angry things will just become more stressful, However, I would suggest you look for a new apartment and once you find one, give your Landlord 30 days notice and move.

Your MIL is misinformed. There is no California law that taxes non-resident owners differently than resident owners on real property taxes. Some states have such provisions, usually states with large numbers of vacation homes, such as Hawaii. California does not do that. If she uses a property management company, they would have to start withholding 7% of her rental income if she leaves the state, sort of like income tax withholding on a pay check. Also, if she were to simply deed the property to the three children now, there would be seriously higher taxes once THEY went to sell the property. Those are the only things I can think of that her misinformation might be based on. Taxation aside, however, an inter vivos trust is a great idea 99.99% of the time when dealing with real estate you want to leave to your children. It is VERY tax-favored once you pass away.

I recently found out that my cousin had a bench warrant out on her for failure to appear in court/pay fines on a misdemeanor shoplifting charge (she claimed she didn't have to go because the national retailer dropped the charges). Earlier in the week, I called the local police department and told them where she would be and about the bench warrant. I also gave them my name. That day, she was arrested for the bench warrant. Another relative posted her bail and she is now back home. This has caused major turmoil in my family. A few people think I did it. To try to keep the peace, I denied making the call. I have now heard that my cousin has hired a lawyer and that they are waiting on her "police report" and claim that the report will have my name and phone number on it and she will sue me. I did not make any false allegations. I simply called the police, said where she was, that's it. Does such a "police report" exist? Can I really be sued for calling the tip line? Even though I gave my name, wouldn't my identity be protected as a source?

Why I answered you will think: it is because if I let my cellph ring (this case her) and my CUSTOMERS would call at the same moment, for my customers will go automatically to my voice mail (which I KNOW for experience THEY will go to another provider right away IF not answered) so, by answering to this stalker at least I could hear perhaps a "waiting call" from my customers. I took proof of my cellph bill -how she rang up my min- I also called the police after 2 and half hour of her calling me that TUE and ONLY then after police called her, she stoped calling me. She told the judge "she was desperate" that's why she called me that much and "she should'nt pay nothing". It is really hard to say without reviewing your contract and having a better understanding of the scope of the work. Typically, if the contractor is going to exceed their budget, the parties will agree to a 'change order' or have some discussion that additional costs are required before they are incurred. When you say the project was finished, did you get an e-mail or telephone call, or final sign off of some kind from the contractor indicating that the project was complete? The fact that your contractor called this a 'fair settlement' makes me think there is more going on here.

If true, the fact that you got this additional $5,000.00 bill months after the project was finished is certainly very suspect, and you may want to speak to a lawyer about your options and know the consequences before you decide one way or another.

Well, first of all, the answer to legal questions like this will generally depend upon the state law of the state specified in your contract, if any, under the laws of which the contract will be construed and governed. It may be illegal in a few states, but I think is legal in California and most other states.

The, of course, the second factor to be considered is whether the contract actually contains a provision for the deposited funds to accrue to the online store if not used. The store can't just make stuff like this up out of thin air.

So, in order for you to be entitled to a refund, the provision has to be lawful in the state under whose laws the contract will be interpreted, and it has to be a term of the contract. Absent either factor, you'd be entitled to a refund.

From the facts you described, it sounds like you might be liable for the damage to the car. However, it is rare that a dog hits a car. Therefore, it is odd thaat the woman wants to geet paid for hitting your dog. The facts will determine liability. You might look at your insurance again. Your agent may be wrong about your coverage. If you have homeowners coverage, it may be cheap to add $5,000 in general liability coverage.

When I asked to get copies of my daughter's records, I had to provide her birth certificate, my driver's license, and also our divorce decree. I have not had any issues with receiving medical documents. The issue now is that I have noticed that my daughter's most recent ER visit paperwork states that my ex's new husband told the doctor's my daughter was his offspring (documented in daughter's record), and he also signed documentation stating his relationship to patient was father. Our Consent Order states that the designation of mom/dad and any variation of those two words, other than with step preceding, was not allowed. My question is.... should I be going after my ex's husband for impersonation, going after my ex for listing him in the slot I should be, or both of them?

Determining whether to award spousal support and if so how much is a complex analysis requiring the court to address something like 45 different statutory factors. One of the key ones is length of marriage, which you don't even mention. It sounds, however, pretty unlikely that you would be ordered to pay support at this time, although the court might be persuaded to retain jurisdiction to award support if and when you get a job, and order that you report to the court on your efforts to find one. That is more likely if you have children and child support will be an issue as well as spousal.
