I would strongly encourage your mother in law to schedule an appointment with an estate planning attorney. If your mother in law does not prepare a will or otherwise transfer the property, the three boys will inherit the property. Assuming no other survivors, the three boys would inherit the home in equal shares. The chances that all three will be able to agree on exactly how to manage it, and have the resources to split all repairs and costs equally three ways is slim. With a will in place, the mother in law could specifically instruct what is to become of the property, whether the house is to be sold, and what is to be done with the proceeds, along with the rest of her estate. There are a number of moving parts here, and transfers of property can have consequences (including tax liability, capital gains, medicaid, etc).

There appear to be several civil actions available against such a landlord. You might even be abler you sue the landlord in the Missouri County where your employer is located. But,you should also confer with an Illinois attorney too. If the party that you rent from is a corporation, and the person used their personal email account to communicate to your employer, they may have violated federal AND state law.

The fact that your mother died without a will has no bearing on whether you should probate an estate.

You indicate that your mother had a little insurance money. Was this life insurance? And who was the beneficiary if so? If you or another sibling was beneficiary, then that designated person gets the money and gets to keep it. If no person was designated, then you definitely need to probate an estate for your mother as the insurer will only release the money to her personal representative.

What I would do is talk with the register of wills (assuming your mother lived in Pennsylvania) and see if you will need to probate an estate for your mother. The question will be whether your mother had assets. If so, then you will need to probate an estate. Depending on the nature of the assets, they may have to be sold and the proceeds used to pay your mother's debts. The debts must be paid before the heirs can inherit under the intestacy law (other than a family exemption). If there is not enough money in the estate to satisfy the claims of all creditors, then the claims are paid in order of priority as per state law. I suggest that in such case that you hire a probate attorney to assist you.

If there are no assets justifying probate, then I would write a letter to each of your mother's creditors and send them a copy of the death certificate. I would advise the creditors that your mother has passed and that she had no probate assets and that an estate will not be opened. Send the letter via certified mail and keep a copy for you.

The short answer is no. Any debt incurred by your mother is owed by her estate not you. As my brother in law also an attorney say you send them a "So sorry" letter to each creditor and that's all they're going to get. If the say that somehow YOU are responsible that's not true. Though some might try to make it sound like you are.

Are you a "current" beneficiary (meaning your rights have fully vested), or are you a "future" beneficiary (meaning your rights vest once your father passes away). If you are only a future beneficiary, then you have no rights to an accounting. If your father needs a conservatorship of his estate, then you can have the Court appoint you as conservator and pursue claims against your sister on your father's behalf.

You might simply ask your father if you can review his bank statements and other financial papers with him, to see what is going on. Your father should be interested at least in how much money he has.

And, now, until I meet her demands, she is denying me all visitation priviledges. In fact, she won't even let me speak with my children on the phone.

And my concerns are not exclusive to me. My ex-wife's own sister reported her to child protective services because she is concerned about the welfare of my children.

I don't have money for an attorney. Please tell me how I can remedy this. In defense of your former attorney - people forget we have to pay bills, we have family to support and we are not able to continue representation for free.

As to your situation, if you are without funds, then apply to the Legal Aid office in your area.

Otherwise, go online to the clerk's office for family law forms - file a contempt/enforcement and get a hearing date and have her served. Remember - if you make a mistake you can not do over - I suggest you find an attorney or make arrangements with the one you had.

Representation of children is not a game. It is not a case of pro se representative. Unless you know the law, do not take chances with your children. If your former wife is being investigated by children services, then you know your children may be in danger. Call the children services, find out what is going on.

On a Texas divorce petition, if you are using a current Texas form, now only basic information is included because the Texas legislature recognized several years ago that identity theft was a problem.

So your question alarms me -- if the petition you are using is asking for a lot of "personal information" the red flags are going off in my head -- WARNING - WARNING - WARNING - it sounds like you have a bad form in your possession!

If you purchased an office supply kit, a kit off the television, off the internet or from a "friend" or a paralegal, you probably got "ripped off".

Once again, I encourage people to hire a competent family law attorney to do their divorces. People think that they can save money by not hiring an attorney but often they spend MORE money by trying to save money.

You or your employer may be confusing issues. Metlife, which I assume is the company's short-term disability insurer, has nothing to do with FMLA leave. Assuming you are eligible for FMLA leave (the company must have at least 50 local employees and you must have been with them on a full-time basis for at least a year), you should be eligible for protection if you were seriously ill and unable to perform the essential functions of your job due to that illness. There is no 3 day requirement, though the employer may require you to obtain medical certification from your doctor. This does not mean the employer must pay you for your time off, though you can opt for vacation pay or any sick pay left, nor does the insurer have to cover you if you do not meet its eligibility requirements.

Certainly the seller is responsible to you. The liability of the auction company depends on how much they knew or should have known under the circumstances about the history of the car. If you have not done so already, you should certainly contact the auction company (either personally or--better--through a lawyer) and inform them that they sold you a stolen car.

If you are a co-owner of the vehicle involved, that is all the basis needed. Owners of vehicles are equally responsible for accidents caused by different drivers.

And, it makes sense to sue you if you are an additional party listed on the insurance policy, as they are suing on the policy, presumably.

In the end, as long as a minor accident within the policy limits, give it to your insurance company, and you'll be taken care of.

I dont know about other states, but in Michigan you can take the drivers test at age 18 without having taken a drivers ed course. I have a friend who did it that way. You still have to pass all the written and practical tests, however. They may have changed that law since i was 16, though.

I left for a business trip out of the state on a Sunday, and returned that week Thursday night at 10:30pm. The next morning I woke up and my car was gone. Upon investigation I learned that the HOA gave about 4 days notice of this parking lot line painting. I called them and offered to send my plane tickets as proof that I was not there and that they didnt even give us one full week of notice for this. They said they did not care of the reasons and they felt they gave enough notice. I read the bylaws and HOA info booket given to me when I bought the home and there is no guidance there as to how much notice they would give or what the procedure would be when they paint the parking lot. I would like to take them to small claims court to get back the fees I paid for getting my car out of the tow lot and the miliage charges to reimburse my sister n law for picking me up and taking me to the lot to retrieve the vehicle. This all happened in July... which happends to be the highest traveling season in this country. I am wondering why they didnt give people ample notice. Either way, I want to know if this sounds worth me taking to small claims court.

I appreciate your ire, but I doubt the amount you may have spent on retrieving your car would be worth your time even in small claims court. Your chances of winning aren't good, since there was no express violation of HOA bylaws. These groups are considered in the law to be mini "governments" capable of running themselves through their bylaws. What you could try to do going forward is to seek an amendment to the bylaws to combat this problem.

Usually no, because concept cars/ prototypes, usually don't have a vin #, haven't gone thru federal safety testing. Not for street use. Usually get a Bill of sale only.

You can build your own car from a kit and get a title. Is that considered a concept car? Possibly. Trust your local DMV to provide you with the correct answer.

Kit cars are not concept car and usually use a donor car, the kit is in production and base/use parts, (I.E. the motors, brakes from production vehicles). Kit cars frames have to meet a safety standard. If it has a vin maybe< but I've never seen one with a vin.

The judge must conduct a hearing to determine if you are qualified to represent yourself. If you are not, then you must have a lawyer. If you are indigent, one should be appointed. If you are not indigent, then the judge CAN order you to come to court daily until you hire one so that you are not controlling the docket which is what it sounds like you are trying to do.

14 months is not an a LONG time with regard to a trial date for a person on bond - especially depending on the county. In Harris county, many defendants in custody wait far more than that. While you may have speedy trial rights, your rights to not supercede everyone else's rights. And, the lawyer has the absolute decision about every aspect of the case except whether to have a trial and whether or not you testify. A good lawyer will review everything and explain decisions to you, but the lawyer makes the final decision.

Hire a lawyer. You are causing your case to be further delayed.

During the divorce process, my ex was able to secure a Civil Protective Order, (not criminal), based upon my condition with PTSD related to gulf war, my subsequent mental health treatment by the VA, and access to firearms.

I am not a man of any means and she retains all of the joint assets. I cannot afford an attorney and until yesterday worked part time at walmart to make ends meet. Having looked at Iowa code, it states that i cannot "posses" any offensive firearms or ammunition. my question is, that by Iowa code, can I re-open the range as long as myself, and the range neither own or posses any firearms or ammunition?

This is a membership based facility and the members themselves retain possession of their own firearms and accessories. I merely provide a facility for them to shoot at.

This is an interesting question. The Lautenberg amendments prohibit people who are the subject of protective orders (civil and criminal) from possession of firearms. You could try and get her to drop the protective order. But if not, the question would be "what constitutes possession" of a firearm or offensive weapon. Unless you actually possess it it comes down to an issue of constructive possession and that is an ill defined term. If you are in exclusive possession of the premises that weighs heavily against you. A final tax return (and any other unfiled returns) must be filed for the decedent. The decedent's estate should receive the refund. After all of the probate procedures have been followed and expenses paid, your husband should receive what is left from the estate. Otherwise, you must file an answer and counterclaim within 30 days of being served. (If you are being sued in one of the Georgia state courts.). You can generally deny liability, among other responses. If you don't respond within 30 days, the court may enter a default judgment.

In addition, you may consider filling a counterclaim for contacting your father and grandmother. There are several claims, including invasion of privacy

When were you served with a complaint? You have 30 days to file an answer. After the answer is filed, then you get to engage in discovery and not before.

If you want to litigate, then go to a lawyer specializing in credit card defense.

Before you do though, ask yourself these questions:

(1) Notwithstanding that nothing with the credit card number is attached to this account, who is suing? The original creditor or a junk debt buyer?

(2) How long has it been since you stopped paying on the card or how long has it been since it was alleged in the complaint? If it is 6 years or less, the action is timely. If its over 6 years, you may have a valid defense and you should see the credit card lawyer immediately so you can raise the defense in your answer. If the defense is not raised, its waived - meaning you cannot assert it.

(3) Is this really your debt? Only you know the answer to that question. You have a moral, if not legal, duty to pay your debts. Yes, you can pay a lawyer to fight, but if you have no defenses (like the statute of limitations), then they credit card company will get a judgment against you. If you do nothing, the credit card company will also get a judgment against you, albeit sooner. The only difference is that for every dollar you make them spend, this may be added to any judgment. Also, if you become enough of an irritant, they may refuse to settle with you and you will end up paying the whole amount. So carefully consider whether it makes sense to litigate or not.

(4) Do you have a lot of other debts? In such case, would it be wiser to file bankruptcy rather than fight the lawsuit? If you have not had a consult with a bankruptcy attorney, then I suggest that you get one. Many attorneys give free consults. And just because you have a consult does not mean that you have to file today. Bankruptcy can be filed even after the entry of judgment.

(5) Bankruptcy is not right for everyone and I don't know your circumstances. There are alternatives are there besides bankruptcy or litigation. Debts can be settled at any time if you have the funds. Creditors and collectors prefer lump sums, but some creditors will spread out the settlement over payments from 2 to 12 months. I don't like long term arrangements, but it depends on the law firm and the particular creditor or junk debt buyer as to what they will do. Discover, for example, won't let you make more than 3 payments; others are more lenient. If you can't afford to settle at all, some creditors will allow you to make payments on the debt. I am not a fan of this either because you are paying on the whole debt. But, if wage garnishment or levy on other assets is a possibility, it may make sense.

I am not sympathetic to the credit card companies. However, I also don't believe the answer lies in fighting in court except on those rare occasions where the statute of limitations or some other valid defense exists. Lawyers who focus on litigating may have a different opinion and I respect that. But I believe in settling the debt, not litigating, if this is really your debt and there are no defenses.

Who is the law firm? Frederick Hanna? The Reagin Law Group? Pollack & Rosen? Emmett Goodman? Craig Goodman? Who is the creditor - Discover? American Express? Capitol One? Someone else? Or is it a junk debt buyer?

All have different limits as to what they will settle for. Depending on when you settle, settlements can range anywhere from 40% to 80% on average. Settlement will be based on whatever the balance is at the time you go to settle the debt.

With respect to your question about calling your father and grandmother, this is not the same company that sued you. They would not be calling so I suspect that this is for another debt. Resolving the debt is one way if its the same people that sued. However, if its not, you need to write to them. If its a debt collector, then the debt collector is not allowed to call third-parties (like your dad or grandma) unless its for the sole purpose of obtaining your location information. If you write to them and tell them not to contact you at work as your employer does not allow you to receive personal phone calls and not to contact third parties like dad or grandma and only to contact you in writing at your residence, then they have to obey or risk being in violation of the law. If you have an attorney and they know you are represented, that will also stop them. Your father and grandmother could also write to them and tell them that you do not live there and to stop harassing them.

Debt collectors must send you a letter within 5 business days after they first try to call. Have you received a letter from them? Have you disputed the debt or written to them about the debt? If you have not received a letter, do you know their phone number? If so, Google it to make sure that you have identified the correct collector. Once you get the name, its easy to get their address.

It might be hard to get this modified, but you can give it a try. The judge may take into account the fact that your boyfriend is now better on medication. However, they may also think that your boyfriend will go off medication after he gets out of jail. You might ask an attorney to help you request the modification.

Hello-You said "tickets" as in more than one. If this is the case, you should never just pay them all.

You should contact the Clerk of Court for the County where you got the ticket. Ask what is the status of each ticket? If sent to collections...in Duval Cty, the Clerk has a Motion we file to reopen the case. (This takes it out of collections). If you simply pay the tickets to the collections agency, they add 40%. Also, when we file appropriate Motions, we get the cases consolidated in one Court (if they are in same County) and ask the Court to let us plead to one or two and have the rest dismissed. This way you won't pay fines on the ones dismissed. Also, if you have a lot of tickets, you get a lot of points, unless you get some dismissed in a plea deal.

There are different Motions if the tickets have different status', such as you never went to court or you went to Court, but didn't pay the fine. If your license is susp. due to points, they have a Motion to set aside a prior ticket that had points assessed. That's why I said ask the Clerk for the status of each ticket. Of course, you could hire an atty. to do these things for you...just make sure the atty. has handled these Motions before. Good luck. Tom Rosenblum, Jacksonville

On my lease, it makes no mention of this fee, although the move-IN fees were clearly outlined. I do not think I should be paying the move-out fee since I was not aware of it. However, my lease has a catch-all statement that the owner is pointing to when I asked if he would pay the move-out fee.

The relevant lines of the lease states:

- Lessee is responsible for paying a $250.00 move-in fee, plus a separate check for a security deposit of $200.00, both payable to XXX (the Management Company). It is understood that the $250.00 move-in fee is non-refundable.

Let's be practical here. The lease refers to the HOA rules. Every condo lease has to incorporate them by reference. A lot of people check them out ahead of time, since they have things like pets, or they smoke, or something else that there may be a rule against even if it isn't in the lease. You were put on due inquiry, constructive notice, that there were more "rules". At least the fact that there were more rules wasn't hidden. And for all your know the move out charge was added after your lease was signed - that's one reason why leases are worded that way: often new rules come into play. And if you paid a move-in fee with elevator charges, do you really really believe there would be no move-out fee? Lastly, you're in Chicago and assuming your lease is covered by the Chicago Residential Landlord and Tenant Ordinance even it does not address this issue, but it DOES say that if you breach the lease for anything other than non-payment of rent, you don't pay the charges and your landlord winds up being hit with them, the amount could be deducted from your security deposit and/or your landlord could sue you and if he or she wins would get not only the charge amount, but court costs and if he or she has an attorney go after you, the attorney fees.

Please note that even if she wins and he has to pay child support HE would have to file for visitation. So my question is this: if the accident is in CA, hospital treatment in AZ, my brother lives in Mexico, and his attorney is in CA.... which law applies to the hospital lien, CA or AZ?

I am not sure what you mean by 'they made me a violation of his probation.' However if this ex-boyfriend was already found to be in violation of probation, that won't be undone; however, he may now be able to do things (e.g., see you) that previously were forbidden by his probation, so that seeing you now may not be a *new* violation of probation. You and the judge both may have to agree that the restraining order is no longer necessary ... you wishes alone may or may not do it. Good luck!
