No. The property manager cannot appear in Superior Court for the landlord unless the property manager is a licensed attorney.

Absolutely not. If your sister is receiving SSI and Medicaid the disclaimer of an inheritance is considered a divestment. Any divestment is penalized by Social Security anit-fraud statute. This penalizes a person 1 month of benefits for every $674 in value. Your sister is much better off in having the inheritance placed into a special needs trust for her benefit. It is fortunate that your father established a special needs trust before his demise. If not then you would have to seek court protection.

You have partial payments which take this outside the statute of frauds (which usually requires a writing). I don't know how much was borrowed or how much is left on the loan or any of the circumstances, so this is just general advice and may change depending on the facts. You can do a couple of things:

(1) How much can you afford to pay total if they will accept some lesser amount as settled in full? There is a time value to money and paying out x dollars per month over a term is worth more than paying a lesser sum today. If you have the cash, try that.

(2) If they will not accept it, what's the lawyer going to do? Sue? Really? And cost the estate even more money? You are in PA. While a judgment will give them certain rights to seize property (and I don't know what you own or your circumstances), getting a judgment is NOT going to get them paid any faster. There is no wage garnishment. Keep paying as per the agreement or keep saving until you have enough and call the lawyer's bluff. They can't get a judgment that fast - it will take 45 days at a minimum. So you can stall for some time and maybe you will be in a better position to get this paid off in a few months.

(3) Offer to enter into a new obligation with the heirs. I understand that the heirs want their money now, but its not going to happen. It would be better if you could keep paying as you have done and the heirs will get their money. Any new promise to pay should absolutely be in writing and there should be a reasonable rate of interest attached. This way, the estate can get closed out and while its not ideal, it still would be a win-win for everyone.

(4) Depending on the balance owed, try to borrow the needed sum from friends, family, a bank etc. and pay off the loan to the estate. Make sure that you get a written receipt from the estate that the loan has been satisfied in FULL. You might have to borrow small sums from several people to make this work. Do promissory notes with each and pay them back.

As a general rule, no, your ex can't simply switch daycares without your permission. The two of you are supposed to decide together which daycare your daughter will attend. But does it matter to you? Will it increase the cost you pay for daycare? Will it be further for you to travel to pick up your daughter? Does the "new" daycare have a worse safety record or is it in a bad neighborhood? If any of these things are true, a judge will almost certainly block her attempt to change daycares. The judge will probably not allow two daycares, one for you and one for her.

Make sure you can explain the ramifications of this. Is it a longer travel for you thereby making time sharing more difficult? Is it more expensive? That sounds like a small claims judgment. Have you considered a motion to set aside the judgment on the grounds that you were not served? There are also limitations on service of small claims demands on non-resident defendants. You would still need to appear at the motion hearing, but have you found out whether or not you can appear by telephone?

You can bring legal action against your brother to hold him accountable for his actions. You need the original Will signed by your mother, not copies, and with that, you can open a probate of her estate, and get legal authority to pursue your claims against him. In addition, you can make a claim against the estate for your caregiving services, and for return of money that was yours, and not hers. If she died in California, you will probably need to hire a CA attorney to represent you.

My advice to you would be to join agrassroots level racing organization like SCCA. They have racingwhich is very low cost to enter, it's always sanctioned, it'ssafe(r), and you won't get a ticket doing it.

I can honestly say, as a former street racer, it's really so muchbetter to keep it off the streets.

The house is your separate property. Adding your wife to the refinanced mortgage does not affect this characterization. If a divorce were granted, the Court would be able to make what is known as a "just and right" division of the property that you share. When making that determination, the Court considers several things. Among them would undoubtedly be the mortgage payments, which I would assume were made using income earned by you and/or your wife during your marriage. Since this income is community property, and it is used to pay down the indebtedness of your separate property, the Court would have to consider the balance of equity when it makes its division of the property, and it may very well use other marital property assets to offset the benefit that your separate property received from the community funds.

I sincerely hope that the marriage can remain intact if that is your desire. If it isn't, you need to have a serious conversation with a divorce lawyer outside of a public forum like this.

I'm sorry to hear that you have lost your mother. This is a very common situation, and one that can produce very strong emotions and disagreements. As a threshold matter, you most likely cannot (and should not) unilaterally sell the property out from under the other beneficiaries unless the estate is in dire financial straights and is at risk from creditors anyway.

Generally speaking, you cannot be forced to own property with others if you do not wish.

You have a couple options, and the best option may simply be the one that everybody can agree on.

You have an opportunity to purchase your other co-owners' shares of the property.

You have an opportunity to sell your share to your co-owners.

You can all agree to sell the property and divide the proceeds.

If you cannot agree to any of the above, you have the right to file a Petition for Partition in Court. Once filed, generally the court will proceed to force the sale of the property and equitably divide the proceeds.

I do not recommend doing this without an attorney. We are currently handling a great number of cases just like this on behalf of individuals, non-married persons, and estates. In certain circumstances, our office is willing to completely defer payment of our fees until the sale of the home.

You shouldn't have to do anything. Notify your bank that the charge was erroneous, and that should take care of the problem, if IHOP hasn't already corrected it on their end.

This is the risk of using your debit card for transactions -- mistakes happen. Even more difficulties ensue when fraud occurs. Good question and a hard one depending on where one is located.

It is inappropriate for a teacher to enforce her religion on students, but is she expressing her First Amendment Right to Free Speech and Religion by telling you that it is her "religious duty" to make the statement.

I would think that the federal courts would say that she has no right to violate others freedom of expression while she is in control of the classroom and therefore she may not make such a comment. She does have academic freedom but that is circumscribed by her responsibilities as a public employee not to use her position to promote her religion.

As a Christian, I would find her comments offensive in the classroom or any other place. I can imagine how non-Christians feel when she makes that statement.

At death home stated no money was due; 11/2012 they refunded me a check ($184) to close her acct. April 2014 I was contacted by collection agency on their behalf owing over $1400. Home stated that they did tell me no money was due, they did refund, they did not send statements (person in charge of acct was fired) in the past 18 months & they turned me into collections. One person at home had stated 'not to worry, I will make it go away'; then apologized it was not done at the next phone call; next call asked for the internal email from the home from 11/2012 where one employee instructed another to write me a check to close the account, the next phone call I was advised by another party at the home stating they were no longer allowed to talk to me, just deal with collection company & pay (their amount was different). After a year I had started cleaning out files & throwing my dec'd mom's papers as I felt it was no longer necessary to keep. With no contact after 18 months, no statements sent, and the last document being a refund sent to me, is right to turn me into collection agency

If you are interested in perusing legal action against this hotel you need to hire a lawyer immediately. The fact that your wife took pictures, and the fact that you went to the hospital for this incident will be vital to your lawsuit. Your question is probably impossible to answer on a forum like this. As to the last parts, there are ways to change venues and judges, and they are limited by time and other issues. If you are pro se you can contact your local legal services, and the attorney general's office for help. Also you should consult with a consumer protection attorney, if you have a case that is a violation of the Florida Consumer Collections Practices Act, then the attorney should take on your case at no cost to you.

Our Chapter 7 bankruptcy was discharged in July 2011. We surrendered our home back to the lender in the bankruptcy. In mid-July our mortgage lender requested and was granted a lift of automatic stay. We moved out at the beginning of August in preparation for the foreclosure. Our house is still vacant, the lender is still sending us monthly mortgage statements, and loan modification offers/paperwork (which we are not interested in, because our rental property is larger and in a much nicer neighborhood than our old house...and the rent is cheaper than what our mortgage was), and we haven't heard anything from the lender or their attorney about the foreclosure. Meanwhile the lender has secured company that has secured the property (there is a lock box on the door) and signs in the windows indicating the property has been winterized and giving a number to call for code violations, break-ins, and other emergencies. Is there a way to "force" the foreclosure to get the bank moving along on this process? We would like to fully move on with our lives.

Our Chapter 7 bankruptcy was discharged You can't force them to foreclose faster, but you can force them to stop sendng you billing statements and notices.

Your wife very well could be eligible for EB1, however, I cannot make any assertions without reviewing her documents & knowing more about any potential petitioners, if she qualifies as an outstanding researcher, etc.

Also, if she is going to fall out of status soon, she needs to change her status to H-4. However, if she has OPT, or is planning on obtaining an OPT STEM extension, that is better for her.

She should have an experienced immigration attorney review her documents if she is interested in pursuing an EB1 petition.

A power of attorney -- even a durable one -- is only a grant of joint authority to you (the agent) by your father (the principal). It does not remove any authority related to your father's finances that he holds, as it merely authorizes you to engage in specific acts, as he instructs, and within his best interests. Your father doesn't need your consent to manage his financial affairs.

Add to that the fact that powers of attorney are completely revocable. You may not want to rock the boat if in turn your father decides that he no longer wishes to have you serve as his agent.

In 2007 I was sentenced to serve a 5 year sentence and when sentenced was given 1 year and 39 days credit (jail time). After 2 years I was released and am currently on parole. The problem is that I didn't receive the credit that I was granted. I do have my court papers showing that I was granted this time credit. I don't want to serve a year and 39 days that I don't have to serve so my question is, what would I have to do to resolve my problem with my time credit?

TDC will not honor credit given by a judge if there is not basis for it. Back in the day, people used to negotiate sentences right down to how much credit they were giving - regardess of how much credit they actually had. This was commonplace and no one complained. However, in the years lately, TDC started reviewing the paperwork sent to them regarding the sentence and refusing to go along with this wink and nod method of credit. Someone complained in a writ or lawsuit a few years back and lost - TDC won - the court said one cannot be awarded credit that one has not earned. So, most courts have quit doing this. That said, every so often TDC finds that someone was given too much credit (or so they think. Some times they are wrong because the person has credit because there was a detainer against them, etc.)

So, the first question is - are you being denied credit to which you are legally entitled? If the answer to that is no - you are not entitled to the credit legally - then there is nothing you can do.

If the answer is that TDC is wrongfully denying you credit for time that you have coming to you, then the first step is to dispute the calculation directly with TDC. I have never been directly involved in this because most clients simply do the process themselves. You should contact TDC classification in Huntsville to find out what steps you need to take to dispute your credit. If they do not agree with your proposal and you continue to think you are entitled to more time, then you will need to hire a lawyer to talk with them and then possibly file a lawsuit.

You need a lot more than a phone number. You may have a lot of issues that may preclude your mechanic's lien, and subject you to a future action for slander of title.

First of all, you seem unfamiliar with mechanic's liens, which makes me think you do not have a license. In general, an unlicensed contractor cannot legitimately record and foreclose on a mechanic's lien in California. If you are a materialman who delivered material to a prime contractor, you would be allowed to assert a mechanic's lien.

If you have a license, you must give the requisite notice in Civil Code section 3097. There are also different time requirements, which must be watched or your lien will be invalid.

I suggest you speak at length with an attorney experienced with mechanic's liens, instead of doing it yourself.

I have been wrangling with the Kroger Company of Michigan for the last 10 months with very little success. I started there in 2006, worked until 2008 and left for school. I worked for them each summer and Christmas right up until Christmas 2010. I was hired again that Christmas (2010) and still thought that everything was ok and that I still had standing with the company, certainly enough to come back. I came back a final time for two weeks in May 2011 and was told by my boss that she had to terminate me and that she was ordered by corporate and that they would not even consider reinstating this. Apparently I had been coded incorrectly in Kroger's computer system as having "left for another job" or something to that effect at the end of Summer 2010 despite having specifically stated that I was going back to school when I gave my two weeks notice as requested by my boss every time I left and intended to return, apparently this code makes it so that I can never work there again. This was of course incorrect as I had actually been leaving for school. I have asked to see the error in my employee file and been denied the opportunity to see it, receiving a "we can't show you because we can't see it ourselves" response from the corporate office's HR people. I have had no luck in communicating with this company as my phone calls are not returned or promises to be called back by a representative are not fulfilled. Do I have any recourse in trying to get my job back since I did nothing wrong or at least to see my file?

Getting your job back may be tough, but getting your file should be easy. There is a statute in Michigan called the Bullard Plawecki Right To Know Act. Rather than an eviction, in this case your recourse would likely be to repossess your mobile home. It's a bit of a complicated process, but given that there is no rent or formal agreement it should be clear-cut. It does not matter where the executor lives. Where is the estate pending? NC has no inheritance taxes if the estate is pending in NC. If the estate is pending in PA, there is inheritance tax. Also, if the estate is pending in any state other than PA and your mother owned land or had other property in PA there would be inheritance tax also.

Your post suggests that your mother resided in NC at the time of her death. In such case, her estate would be in NC and, assuming that she owned nothing in PA, there would be no inheritance tax at all.

With regard to your second question, there is either a will or no will. If your mother had a will, her assets must be distributed as per the will. If there is no will, then your mother's assets must be distributed as per the state intestacy laws. As your mother had at least you and your brother (assuming there is no surviving spouse and no other children), then you would split the probate assets 50/50 with your brother.

You do not indicate what assets your mother owned and what is or is not a probate asset. Probate only concerns probate assets. Any assets that passed outside of probate (usually things like life insurance, IRAs, 401(k)s, annuities, pensions or joint bank accounts) go to the named beneficiary. Further, any claims against the estate have to be paid before the heirs under the will or intestacy law inherit any probate assets.

Your post does not make sense. Why would your brother assert a right to 100% of your mother's estate unless there was a will specifically stating that he gets everything and you are disinherited? And why would he make a gift to you? I don't know what is in the estate but if he did that, he possibly would have gift tax issues of his own. That is not recommended unless the will specifically gives your brother everything.

It is unclear to me whether your case was filed in Ohio or West Virginia. It was filed in Ohio than as an Ohio attorney I might be able to provide you with some guidance. But if it was filed in West Virginia I did not have all licensed to practice law in that state and cannot help you.

Until you are served, there is nothing that you are legally required to do. There is a time period of 120 days to serve you. Extensions can be obtained if they can't find you to serve you. Have you been out of state, country or hiding from service? You may want to get a copy of the complete court file and meet with a lawyer to discuss the matter. You need to at least verify that the court file does not indicate that you were served.

Probably not. Generally an employer is not liable for the criminal actions of his employee, unless he had knowledge of past thefts by this individual. You can certainly sue the driver in small claims court and report the theft to the police.

My daughter didn't take her name off of the electric bill when she moved from a home in Seattle. She moved in Dec.,recently she received a bill, her first since her move, it was $925.00. She contacted the electric company, they will not take her name off of the account. Someone at the home has closed the account that has her name on it and has created a new account. The electric company has advised her to contact the owner of the home. Which she is in the process of doing. Can you advise on how this can be resolved so that my daughter is not responsible for a bill she did not help to create?

Let's start from when your daughter moved out. She should have notified the utility companies that she was leaving and would no longer be paying the bill. She can ask the utility for a statement through the date she vacated.

She should have heard from the landlord if there was any outstanding money due to the landlord, for example if the utility was billing the landlord for outstanding utilities.

I'd want to look at the contract she signed with the utility for services, and how they determined that she has an obligation for an additional three months of services.

She needs to write to the landlord and send a copy of the same letter to the utility, and when she gets a response, she needs to be sure the utility gets a copy of the landlord's response.

Worst case she can sue the landlord in small claims for the bills she did not incur, but bottom line she has to be able to show she told the utility she was leaving.

I was on parole 3 1/2 additional years and got taken off parole towards the end of 2012 without further incident. In a few years you may seek to have your record expunged. I am not sure what you mean by "sealed" But, in the digital age, it may be fantasy to think that a future employer will not be able to discover that you were convicted.

It sounds like you don't have an attorney. You really need one.

Her signature is not needed for the judge to eventually sign the final orders.

If you had an attorney, the attorney could set the orders for a time for the judge to sign the orders. If you don't have an attorney, you can appear & ask the judge to sign the orders.

Now getting her to pay is a totally different matter. You will need to file a contempt matter against her at a later date. You will definately need an attorney for that legal matter. Contempt is a technical matter & is extremely difficult without an attorney. I recommend PATRICIA BUSHMAN at 71380709405. In contempt, you can ask the judge to have her pay part or all of your legal fees!

This gentleman has since over a two month duration discontinued communication with me. At first within his story line he promised again to reimburse me, he reimbursed me $600 of the $2000 owed. Then when I reminded him of the balance approximately two weeks ago he now completely avoids my calls.

Can I sue this gentleman? I have his license plate for his vehicle and would also like to know if I can track downhis place of residency from his local dmv with the license plate information to serve himpapers if he can be sued.

Some "boyfriend." He took advantage of you. Never ever loan anybody this kind of money without getting a promissory note.

However, that all said, you can sue him in small claims court. Even if you prevail, how are you going to collect? There is no wage garnishment in PA and if he is a scammer, then chances are that he has a bunch of judgments against him. But it never hurts to try.

You are going to have to track him down and sue him in his county of residence. Before you do, I would write him a letter and send it via UPS/FedEx (people play games with certified mail) and make a formal written demand for the balance owed. How did he pay you the $600? In cash? Or by check/money order? Did you happen to make a copy of the check/money order? It will help in proving your case so that is why I asked. In your letter I would recite all the facts - that you made the loan in December of 2011, that he admitted that he owed you money and that he repaid you $600 on such and such a date. Demand the balance owed and tell him you will pursue your legal remedies if you don't hear from him in 30 days. You might also be willing to cut him some slack if he pays - while you are entitled to the whole $1400, it might be better to at least get some money back and be done. If that appeals to you, offer to settle for $700 or whatever you think is fair provided that he actually pays. And demand that payment be by certified check, in cash or by mnoey order to avoid him stopping payment on a personal check.

If he fails to pay, then try the small claims court.

No, it does not violate Hippa laws, the school does not need to know why he was seen but it is proper to ask for documentation that he actually saw a doctor and was not just skipping school. I recommend that you cooperate, with just getting generic notes from doctors that do not say why your son was out, truancy charges could potentially be filed against you for excessive child absences.

I have primary custody of my 5 year old daughter. Her father is supposed to get her two nights a week and he is supposed to pay child support on the 1st of each month. We have a first right of refusal clause in the parenting plan. There have been numerous ocassions that he just decides not to get her. And more than half the time she is with his mother instead of with him and I am not offered the opportunity to keep her and don't find out until our bedtime call. One time he left her at his friend's house because he had to go to work and I didn't find out until the next day. I have ALWAYS offered him the opportunity to keep her if I needed to have someone watch her, but he has always been unavailable. I also always make sure he knows if she spends the night elsewhere and give his phone number, as well as my own, for emergencies and so he can still have his bedtime call with her. He is also supposed to have her two consecutive weeks in the summer, alternating school breaks and various holidays during the year, but he usually chooses not to take her during these times since he still has to work and "it's not like they're going anywhere." Child support is consistently at least two weeks late. Is there anything I can do to make him follow the court ordered parenting plan and pay child support on time? Someone told me I can't push the child support issue unless he's 30 days late and he's never been more than 26 days late.

If you suspect there is unreported income then it is your job to locate those hidden payments and pursue that. You should subpoena the records of the worker to see what their employment situation is like, and maybe do some surveillance to see what kind of hours are being billed and charged.

Perhaps a resident there alerted Management about "suspected" activities, and "history" of certain individuals that come and go to 1 an apartment there at rental community. The manager has even validated the backgrounds of individuals with local PD. Is it a must that you not share this info? "Ex: a neighbor went to the manager and stated she was frightened, didn't want to know about this issue,crimes going on in community. Is it improper to for the manager to call and inform individual they must keep their mouth shut an not speak about it with others. Isn't that wrong on Managers part? The office manager cannot restrict your free speech with anyone. He obviously is worried that tenants will move out if they here about crime in the community. I would be a little careful because this guy can retaliate against you and find some pretense to try to evict you. So as long as you pay your rent on time and follow the communitiy's written rules, you should be able to discuss any subject you want.

I am renting the house to the two of them. I live 36 miles away with my son. My ex husband's attorney has filed to walk through my rental home. Do I have any legal rights here? You say your ex so I assume that your divorce is final. My next question is why is your ex doing this? Is he trying to get child support payments reduced or trying to get a modification in the custody order? He obviously thinks that the Court will care if he can prove that you are living with someone who you are not married to. I am not sure that the Judge will care. Some do and some don't! What County has the case?

Your tenants do have rights. Unless they have been made actual parties to the action, the court does not have any authority to order them to do anything.

The issue comes back to the previous question. What is it that your ex is trying to accomplish? I need more information before I will be able to take this any further.

You may feel more comfortable with this if you talk directly to an attorney. If you had an attorney for your divorce and are comfortable with that attorney you should talk to him or her. If you no longer have an attorney and would like to talk about this I will be happy to give you a few minutes if you call. No cost or obligation.

most effective way would be to place a de-humidifier inside the vehicle,closing all doors/windows.The moisture is concentated in the soundproofing.If your windows fog up, make certain that your vent position is on 'fresh' air to blow the outside air in, rather than 'recirculate'. Recently I received a call from a past girlfriend that I was involved with 23 years ago. She just told me we have a 22 year old daughter. When we had been together 23 years ago, she had told me she was pregnant and wanted to abort the baby, start seeing an old boyfriend that was getting out of jail, so I needed to leave her and not come back. I gave her $250 for the procedure and did not see her again. We were in California when we were together and now she lives in Georgia and I am still in California. She let the child believe that her father was someone other then me.

You wouldn't owe back child support unless there was an order in place that she obtained when the child was a minor. You need to find out whether she, or the government on her behalf, filed a child support case.
