Pretty unlikely there is a "template," and even if there were, it is even more unlikely you would want to use it. The longer I practice, the more I hate "templates." Contracts written on napkins are usually better than templates because they typically leave most terms blank, whereas templates typically get various terms all wrong FOR YOU.

When you say the Dissolution is Still in Process, I assume you operated as a corporation. As such, until such time as the corporation is completely dissolved, you have an obligation to pay the CA Franchise Tax Board Fees and file a tax return for every year until dissolution.

It is pretty clear that she because she is in an assisted living facility, she will NEVER go to the summer home again unless she has a lot of physical assistance from other people to help her. Who owns the property with her? And now the other questions: how is she going to be able to pay for the assisted care facility? will her money run out? Does she need to give a power-of-attorney to someone to help her deal with her finances, and keep track of the bills and write checks?

See a CPA. A 1099c is a cancellation of debt. The old mortgage should have been replaced by the new one but it should not have triggered a cancellation of the entire mortgage debt. The debt was not cancelled.

This is not a legal question. If the sample wasn't frozen its unlikely to ever be "used" for reproduction purposes. About worrying about being framed this is quite ridiculous unless you already have some reason to suspect you're going to be implicated in a crime.

You would need to review their documents. For example, did this creditor obtain a court judgment that was recorded as a lien? Did the borrower give this creditor a deed of trust or other collateral?

Bankruptcy law requires the proof of claim to have documentation substantiating the claim. If there are no documents, you should object to the claim.

You need a lawyer, very badly. Even your own version of the story raises very troubling questions. You did not know where your 4 year old child was, and did not check on her, so she could have been killed. Your child (or children) frequently spend several hours a day at the "mexican neighbors'" house, but you don't even know them well enough to know their names off the top of your head. It is not surprising the officer got upset, and it won't be surprising of the Judge gets upset and orders a full investigation. You may also hear from DFACS again.

Are they claiming deductions out of your paycheck? If so and they are not in fact sending the money in to the IRS and State Department of Revenue, then they are in violation of the law - but it is an IRS issue more than a personal one. If they are doing this, you need to protect your tax liability by notifying the IRS.

But if they are just calling you "independent contractors" in order to get out of paying social security income tax, then you have a tougher road to overcome. If you are truly an independent contractor you are required to pay your own social security. If you are not then the IRS should help you, but since it is such a small company, it is not likely to be worth a lawsuit against them when they fire you for going to the IRS.

In other words, your best bet is to go to the IRS with your complaint, but be prepared to find another job. If they are not competent to do employees properly, then quitting is ultimately a severe punishment for them.

I know that's not a very good answer, but often it is the only realistic one - especially when dealing with such small employers.

The HOA lien is not superior to the first mortgage so they can only sell the property subject to the first mortgage not with it extinguished. You cannot buy the HOA lien at sale and own the property without the lien. Curious that the HOA is pursuing their matter at all since the lender is responsible under the law to them for payments now. They may be seeking a deficiency against the owner.

My parents are both physically abusive and emotionally abusive. They constantly call my brother names bring him down. My brother constantly calls my parents using extremely degrading curse words. I can't stand the family. My academics would be better in a different environment, I would be able to continue with drumming at my hs in California, i would be able to take my desired AP and honors classes, all of which I can't right now. I know that i could get cps involved, and try to solve the problem that way, but i don't know how long that would take, and if i would even be able to move out and into California from Texas. The reason i don't want it to be a long process is because i would like to be back as soon as i can(to California) so i can register for my AP classes, and other reasons as well. My twin brother lives in California, and i would like to reunite with him(live closely to him). I have a friend that would gladly let me stay with them. As a 15 year old you can't just move out. Based on the facts you have provided, it does sound like there is abuse in the house and CPS may need to get involved to work on the situation or remove you and your brother from your parents. They would not necessarily take you to California.

I do not know why your twin brother is in California and you are here but if you have a parent in California it is possible you could return to California to live with your other parent. If there is a possession order issued as part of a divorce that led you to live with your parents here in Texas then your other parent could seek modification of the possession order to obtain custody over you.

It does not sound like this is a good environment for you regardless of whether you go back to California or somewhere else in Texas. If you do not have somebody in California who can take custody of you through appropriate legal channels then I suggest you speak with CPS about your situation.

Its a pattern for her and she uses the two youngest as leverage to manipulate me and her sons Father to get what she wants. She moved to Atlanta and stayed three years there and didnt see either of the children but twice the whole time she was living in Atlanta. As I previously stated I cant afford the $1500 to $2500 and up for a legal adoption AND to have to fight her in court to get it done. As I said she told us she wanted us to adopt the baby but now years later we are estranged and shes trying to say she wont sign and will take the baby from us. This would DEVASTATE the baby as well as my husband and I. Shes a well adjusted settled healthy happy outgoing adorable little girl. Shes smart beautiful articulate and a joy to raise. Shes our world and I do not want her world turned up side down by a vindictive woman that has no concern for her other than a food stamp check and a higher return on her taxes. Please Please Please tell me that I can do something to prevent her from taking our baby and tell me how I can get full permanent custody of her and change her name to Our last name. My huband and I do not discuss this in front of her BUT my daughter and son discuss it quite freely in her presence. That being him talking to her on the speaker phone and not caring if Megan is near or not. The changing of plates and driver's licenses only affects governmental entities and they are likely required to change them but have not. They are not illegal residents as they have a lease. Your choice to get rid of them is to file an eviction case against them. It appears from what you said that the lease is over you should give them notice that they are holdover tenants and for the time they remain they are responsible for double the rental, depending on what your lease agreement provides. Give them 15 days notice and file suit after that.

I found an old document I sent Barney with my signature on it that matched EXACTLY to the one on the Work For Hire agreement his attorney faxed. Despite the fact that Barney cannot produce an original of the agreement or an email with the signed agreement, he still defends that this phantom Work for Hire agreement was authentic. My attorney fees are really piling up now so I hired a certified handwriting expert and she confirmed my suspicion that the signature was photoshopped. Despite all this Barney is STILL fighting and unwilling to settle on reasonable terms. His attorney said, "How do we know that your client didn't photoshop it himself? You can't prove Barney did it." So I have 2 questions:

1) After this case is concluded and if he is found guilty at the end of trial, do I have any way to recoup my lawyer fees since he committed a crime during our case that heavily prolonged the length of our case?

2) If we settle out of court, can I still pursue criminal action against Barney even if we have a confidentiality clause in our settlement terms?

In our case the judge hasn't asked a word about the exchange of the documents she ordered, our real estate still has not been appraised, and she did not ask either of us about whether or not we were satisfied as far as Discovery went, which I thought was the necessary precursor to the court directing the plaintiff to file for a certificate of readiness and then scheduling a trial date. Correct me if I'm wrong but isn't the referral to a court appointed referee to hear the issues of equitable distribution and other ancillary issues the beginning of the trial stage? I just don't understand how the judge can make decisions without appraising our real estate, etc.

My questions are: are the note of issue and certificate of readiness NOT required? Does the judge NOT have to make sure the parties are satisfied with the exchange of Discovery prior to sending the case to a court appointed referee? You don't need to pay her anything. Your situation is such that no reasonable person would remain in occupancy. This is constructive eviction, and you can sue for it. Sue for return of the security deposit plus expenses of moving and the destruction of your leasehold. She seems to have broken the covenant of quiet enjoyment (which has nothing to do with noise).

I was wondering what I need to do to pursue my case. I rented a duplex last May and in less than a month I had to move out. My landlord had promised to fix multiple things including the air conditioner, it was going into summer and I had two small children and was pregnant at the time. The internal temp to my duplex would get up into the 90's and I kept asking for the air conditioner to be fixed. I finally couldn't take it any more and moved out. The duplex had had a window broken out about a week after I signed the lease and the bedroom window in the back I found out had 4 screws put in to keep burglars out which did not help. 3 days after I finally moved all my stuff in my laptop was stolen. A police report was made, there was no forced entry and the next door neighbor was kind of shady, we later found out he could have easily accessed my apartment from the attic. We still don't know who took my laptop, but the next door neighbor moved out rather quickly after my laptop was stolen. Any way, I had paid first and last month like most, $1200 all together, before I knew any of this. We went to court once, the judge said I had a case, but before it could continue, my landlord said I couldn't take him to court, he was just the registered agent, I had to go up against the real estate company. The address that is registered they cannot find, so now I've spent $200 to get him served and go to court and now the courts keep giving me the run around. One tells me I have to have him served in the county he lives and the other told me I have to get him served in the county where the company is. The company address is in Fulton County, GA, and they were not able to serve him at that address, he works and lives in Henry County, GA, but he said I cannot go after him here. Is there anything I can do to get any of this money back?

The best way to lose a suit is usually to do what you did and file it yourself. Suing the correct party in the correct court can be problematic, and the fact you are asking the courts explains why you are really screwing up. Did you not read the signs in the courts that tell you "clerks are prohbited froom giving you legal advice?"

In other words, they cannot tell you what you did wrong. If you want to be your own lawyer you need to take the time to research the law and find out.

A better plan is either hire a lawyer, or, in a case like this where those amounts may exceed what you are suing for, spend $100 or $200 on a consultation to find out what to do and how to do it. As for service, you probably will end up using a private process server. As for who to serve, the answer is based upon your lease.

If you serve the right person you can serve them in another county other than the proper county for suit, but you have to know HOW to do that.

So see a lawyer or continue to waste fees. That's the choice.

Additionally, be prepared for a counterclaim if you breached your lease by moving out early. If you just up and moved because of problems, without taking the appropriate steps under the lease or otherwise (which we do not know), the landlord will sue you for damages. If you can find the courthouse you can file. It's proceeding with the case that is complicated. First you file then you must exhaust all reasonable efforts to find and serve the responding spouse. You need to document these efforts and they need to be more than "I don't know where they are, sorry." Once you can prove to the court that you have taken all reasonable efforts to find them, you can get an order that they be served by publishing notice in a court-approved newspaper. You then file the proof of publication and that serves as proof of service. You will then be able to get a default divorce.

Normally, ED means they are supposed to be roughly half and half for marriages over 10 years and the courts look at lots of things, not just the house's appreciation and upgrades, although you mentioned repairs and upkeep only. The best thing is to avoid a repo in the first place. If you want to keep the car, consider filing a bankruptcy. If the car has been repo'd you may be able to get it back and if you don't want it, it will stop the creditor from suing for a deficiency since the deficiency can be discharged.

If you don't care about the car, you are not saving anything or helping your credit by doing a voluntary as opposed to involuntary repo. Its still a repo and the lender is still going to charge collection costs and its still going to be reported on your credit as a repo. However, once the car is gone, the deficiency becomes like any other unsecured debt and a settlement can be negotiated if and when you have the funds.
