Question

Hello, my girlfriend is a US citizen and I am out of status. She had an arranged marriage with a family member, to bring them to the US, when she was younger. However, the marriage was declared a fraud and she was told she couldn't marry anymore. If I married her and later filed for AOS would it create any problems through INS? Thanks

Answer

The United States Government cannot prohibit anyone from getting married. However, your girlfriend might have been barred from petitioning any future spouses for U.S. Legal Permanent Residency through the U.S. Consulate. Without reviewing any documentation, I cannot answer your question with specificity.

Although I have never heard of a permanent bar to petitioning an immediate relative with USCIS,the prior fraud could be an issue with any future immediate relative/spouse petition that might be filed with USCIS by your girlfriend.
