Answer

The only visa you can apply for is an immigrant visa, since you are marrying a U.S. citizen.

Answer

If you are inside the United States and were lawfully inspected and admitted (through airport/cruise, etc) you could apply to adjust your status here. You also need to be "admissible" which in short means you do not have any criminal or other issues that would make you ineligible to receive your greencard. This process takes anywhere from 4 to 10 months depending on the workload in the immigration office that has jurisdiction over your case.

If you are outside of the United States you can apply for an Immigrant Visa after a family petition is approved by the U.S. Citizenship and Immigration Services. You would also need to show you are "admissible" and that process could take up to 12 months while you wait outside of the Country. I would 100% recommend that you sit with an Immigration Attorney to discuss all possible options as every case is different and it is a legal process. You can call us if you have any other questions (561) 318-3882. Gina M. Fraga, Esq.
