Question

I have a money judgment against me and just recieved 2 writs of execution of money judgment/levys I have no bank accounts own no real property i only get unempoyment benefits can they take this money from me or is it exempt. Do i need to file anything so they can not take this money?

Answer

It is exempt under section 704.120 of the Code of Civil Procedure. If you have no accounts and no property, however, what were the levies on?

Answer

I agree with Mr. McCormick. You don't tell us what they are attempting to levy or execute on. I am also confused by your statement that you receive unemployment benefits, but don't have a bank account. How in the world do you cash the check?

Answer

It is exempt from recovery. However, then can levy your baqnk account and force you to show that the assets are exempt funds. This is a headache that I hope you do not have to go through. I have had a couple of clients in this situation. it is painful.
