Question

I was a Georgia resident and just moved to South Carolina in January 2012. I got married on December 20th 2012. Am I still considered a Georgia resident. I have a Georgia driver's license still. And I want to file for a divorce, Can I file through Georgia? Does it have to be the same county I lived in?

Answer

You became a South Carolina resident in January 2012. Unless your spouse still lives in Georgia, you cannot file in Georgia/

Answer

You have to file where your spouse resides which is South Carolina. Even if you return to Georgia, there is a 6 month residency rule prior to filing for a divorce. You need to speak with an attorney.
